I received a call this afternoon from 1-713-341-5533. I thought it was a patron at first because they were asking me for the address of where I work. Then she asked if "my name" worked there. I said that I was that person. She said that I owed $150 to Preferred Cash and that I had 48 hours to pay the money. She advised me to get a lawyer after telling her I didn't have the money at this time. What should I do? I don't doubt that I owe the money, but I simply cannot pay it at this time. Please advise.

Kathy

Have you been contacted directly by Preferred Cash or by some collection agency hired for the collections? If a CA has placed a call to you, they must send you the account details in writing. If you have not received anything in the mail, send a debt validation letter to them. No actions can be taken against you till you have received the account details in your mail and have reviewed it.

If you are being contacted directly by the original lender, request them to send an itemized statement of your account for review. Make payment arrangements because they can take actions if you don't pay your debt. Request for some extensions and stick to the plan. This will be really helpful rather than finding yourself in troubles.

Desperate Kathy, collectors love to fling around that line "Get a lawyer" because they assume that you don't have the money for a lawyer, and you don't know your rights. Call them back, get an address, and send them a debt validation letter. They can do nothing to you until they prove that you owe them the money. And even after that, there are many steps that have to be taken before they will take you to court. Start with the validation letter, and include a paragraph stating that they are not to contact you by telephone, only in writing. After you have received validation of the debt, contact them to make payment arrangements. They will not want to do that because the collector gets commission on the dollar amount they get you to send. Stick to your guns. Make an arrangement you can afford and pay it as agreed.

Hi Desperate Kathy,

I had did a reverse search on this phone number using various online sources and the information below is what I received verbatim:

"The phone number "(713) 341-5533" is based in Houston, TX and the registered carrier is Time Warner Communications Of Houston, L.p. However, due to number portability, some numbers have been transferred to a new service provider other than the registered carrier."

Kathy:

You do not need to consult an attourney, but you DO need to know your rights! You have the right to tell them not to call you again at your place of employment. You have the right to demand that they contact you by mail only, and that if they continue to call you, you will file harrassment charges.
Ask them to send you a bill in the mail, and pay them as you can.

I have had calls from these people as well, and I did the above and finally got a bill in the mail and paid them off in three payments (of my choosing).

Hope this helps--

Molly Wonser

*p.s. never give out credit card or checking info over the phone unless you are working with a reputable business/catalog/ect. Never send out a payment unless you are sure you owe the creditor money.

I just had a call also... I will be taking the advice of all of the above. I did call them back (long distance number- no toll free), got their name and address, the person to whom the debt is owed, etc.

Wish me luck...
