I went out today, came back to a message on my answering machine. It was automated and it said my husbands name. They gave me a phone number to call and a number to reference. They didn't say who they were, so I called the number back. I got an answering machine. It identified the number as being 'Professional Credit management, Inc.". I hung us, as I just wanted to see who they were.

I was wondering if this is a collection agency or people that help you with your financial problems? As far as I know, I haven't dealt with them or know what they want. anyone here know? thanks, shirley




Hi Shirley

The statutes of limitations are the same for secured as well as unsecured debts. But in case of secured debts, since your property is attached to it, the creditors retain the rights to decide the state where they want to sue a person. It can always be expected that they will choose only that state which has the longest statute of limitations and get the greatest results of filing the lawsuit in their favor.

thanks Roxette, was wondering because of the one wells fargo account, which I'm sure that you're all too familiar with, (I just just reposted the situation a few days ago to get the collectors input on it) is secured. we have three accounts with wells fargo, one, I've been paying directly to them which is below $60 left on it now, the other I'm pay through a collection agency. It was a visa card...and this one that no one seems to want to talk to me about (referring to CA and wells fargo). Its $2000 and was done several years ago. In fact, no longer have the personal property that was attached to loan. A big screen tv that went out, a riding lawnmower that blew up.

I know how you feel about Wells Fargo. We have our home financed through them and they are as crooked as possible. When we hit our financial problem in July, I called them explained the situation and they told me that was my problem. If we can't make the payment, they will foreclose. keep in mind we were never late on one house payment til July 2005. We hired an attorney and Wells Fargo backed off and worked with us. From what i have read, Wells Fargo is crooked and will stab you in the back without you being aware of what they have done. I challanged their entry on our credit report because they reported us delinquent for July and August. i notified all bureaus of the problem and included copies of the police report and FBI report and they have changed the status from delinquent to current never late. If we knew how Wells fargo worked when we loaned through them, we would have went somewhere else for our home loan.

Are you not in a situation to where you could refinance with someone else? The reason I ask, is because we originally had our home loan with chase manhattan, then heard about Aames Home loans. We found out that for half the time it would have took to pay this loan off with Chase, we could do it with Aames and for lower monthly payments. So we jumped right on it. we don't regret it. I know how wells fargo is with personal loans, I couldn't imagine having my house note with them. But I know how it is. I have a loan with Citi financial, and boy was it the biggest mistake we ever made. shirley

We have a prepayment penalty til August 2006. Can't get an apprasial high enough to cover the prepayment penalty. We have found out that Wells Fargo padded the apprasial. Any apprasial we have had done, the home only apprases for $80,000. There apprasial is the only one that apprasied for $87,000. After August, we've been told that we can refinace once the penalty is gone. Only 8 months more of Wells Fargo I hope.

mom of twins, didn't you say that you've been disputing things on your credit report with the credit bureaus? or maybe I am confused. was wondering if you had to purchase credit reports before they would investigate your disputes?? thanks, shirley

I have delt with PCM many times over the years. Doctor offices in this area are really bad about turning collections over to PCM before they ever let you know the insurence hasn't paid. They are usually very nice when you speak to them. However, they will garnish your check in a heart beat if you don't pay. In Arkansas they are allowed to take 25% until the debt is paid. I have had my check garnished before with NO notification that it waas going to happen. They claimed to have sent something in the mail, but I never recieved it. No I just peridically call to make sure mine or my husbands names haven't come up again. I wouldn't just sit back and wait to see what they'll do.

No collector can garnish anyone without court action except for government obligations.
