Need desperate help on summons for providian (palisades col)

To back up a bit & help... 8/2000 we moved to Kentucky to buy a house (Dh parents did we're paying them) and start a new business carpet cleaning in a new town... By 1/2001 it failed due to the van & machine broke down we had no money and no more help from Husband parents, in between all that I used the 5 credit cards to help before the move and to live on and pay bill as we went along..I had 5 CC all in collection, 2 have been settled and 1 paid in full, 2 of them we're from a attorney through capital one who had a judgement with a lein on my house (I was to scared to go to court and had no $) on me we settled after 2.6 years. The 2 Other BIG CC are $3,400. + $5,300. I do have a deal with collection on the $3,400( $100.00 a month) the other one and have been to scared to commite to due to our new business is flexuating. EX: Last year we only made $22,000 for Husband wife and 2 kids.
I have 20 days to write to my side.So we can go to court..HELP! I have no idea where to start,I Have NEVER been to court before. My husband and I do know I need a lawyer for one thing.
Also Providian went on my CR opened date 3/1999 and Palisades went on my CR on 8/2003 Is it past the SOL? Not that it will help any and I want to pay, we though of BR but the debt isn't that bad so we're trying not to do that.. It's not like I'm not trying I just can't pay everyone more then what I can afford...HELP THANKS KRIS

Kris, tell me the date when you last made the payment on the Providian account. And, let me know the name of the state where this account took place. After having this info, I will let you know if the account is out of the SOL period or not.
If you are asked to appear in the court, don't avoid it. Show your appearance in the court and explain the problems. The judge will make decisions after looking into your financial positions. He will offer you realistic plans and you will be able to afford the payments. If you do not go to the court, the judge will get a feeling that you are trying to avoid it. Then, situation might go against you.

I also understand that this account is past the 7 years period. As per the FCRA laws, it should not appear in your file now. It should have been automatically removed by now. There is a need to dispute this item.
Send copies to Palisades also asking for information on this account. Since they are a collection agency, they are required to validate the debt as per the fdcpa laws. Send a debt validation letter in writing through certified mail with return receipt requested. They must respond to you within 30 days after receiving your letter. If they are unable to do, you can send copies to the credit bureau and explain everything.
