I have a major problem with Citibank. I sent a billing error notice to the correct office, and never heard back from them, even after reminding them 60 days later. I sent an accord and satisfaction letter back in May for about 20% of the debt, and they cashed it (I sent it to the same office as my dispute letter, and they forwarded it to the payment center). I thought that was the end of it. Today, 6 months later, I am being sued for almost double what I originally disputed. What can I do? Can they completely ignore me and cash my check (which was a sacrifice at the time, but was about 20%), but then sue me?


Usually, what happens, if there is any billing error, the dispute is to be done within 30 days from the date you received the statement. The company has to respond to your dispute placed in time. Use this point as your defense.

Later, the company cashed your check after sending the accord and satisfaction letter. The company must have read the letter before cashing your check. You must be having the transaction in your bank statement.

Consult an attorney who can advise you with the defense you need to use in the court. Don't fail to go to the court. You must prove your claim in the court because you did what was suitable at that time. If you don't appear in front of the judge, the judge will find you as a defaulter and rule the case against you.
