I wrote a post dated check for a auto repair, which was unablr to be completed, repai shop put check in safe, and promised not to cash until car repair ead complete, 10 months later I am being sued by a third party that cash we d the check...repair shop still has my parts to my car and the tirr and rims

Yeah please give us more details...it almost sounds like a collection agency has attempted to cash the check? If not let us know....I know that it is a defense to refuse payment for work not done properly. I will look around for where I saw it, but I did just see it as I was researching someone else situation..I will try to find it again. But until then, can you give us more details...like what happened with the shop, did they ever try to cash the check, etc.
