Hi faithbarbie
Welcome to the forums.
Once an account is dropped from the credit file, the bureaus can't insert it without genuine reasons. The rules laid down in the Consumer protection afforded by the FCRA say that they will have to notify you in writing within 5 business days along with the proof of inserting the account.
Write a letter to Midland to give you complete details on debt validation as you are disputing it. Also, explain this situation to the credit bureau in writing requesting for a thorough investigation with proof.
After receiving your request, the bureau is required to conduct the complete investigation and serve you the details within 30 days. If no action is taken, you have the rights in requesting them to remove the negative information from your file.
Send your letter through certified mail with return receipt requested. This will leave you with proof of every action being made on the dates specified.
This debt is out of the seven years reporting period and hence was removed from your file. Under no circumstances, the account should re-appear after this period even if the account remains open. You should expect positive results from this action otherwise you can file a class action lawsuit against the bureaus.

What is the status of this paid debt shown in your credit report? If the account has not been updated, it might be due to some clerical mistake by the credit bureaus. You should send a letter of dispute highlighting this entry and request them to update the file. They will conduct the investigation and provide a free copy of your report.
You can also send a letter to Midland Management highlighting this entry and request them to review it. Tell them that this account is not showing your accurate credit profile and your financial worthiness is also getting hurt. They will notify the bureaus.

i just spoke with a collection agency about a debt fromm 1999 they say i owe 500.00 for midland credit associates which was a visa card but then i realize that i was 16 yr old when that acct was opened my mother closed the acct. because i was a minor. now they are trying to collect it what should i do?

Hi Lauren
In which state do you think this account took place? Based on the date of last activity, I believe that this account is out of the SOL period. Also, since your mother closed the account, I highly doubt if there were any charges attached to it before closing.
Ask the collection agency to validate this debt. Also get in touch with your lenders and place this account on dispute with them.
The final impression is that this account might be disputed and should not appear in your credit report also. Also, you can agree to make any payment terms until the debt has been validated by the collection agency. Talk to the financial institution also and see if any charges were attached to it before closing the account.
Midland Credit
I have been dealing with Midland Credit since July of 2005. I never had written notices of any kind. I have receipts of letters I sent requesting documentation for debts I believe are not mine.I was a victim of identity fraud I called Midland and they told me: they do not follow FTC or Federal regulations for consumers. They refused to send signed documentation, remove credit from reports and threaten to "Add" new debt on credit reports.Low and behold I have on my December report 3 new Midland Credits.I filed complaints with Attorney General in AZ, CA and MA they will start investigation with credit reports.I am now in the process of trying to settle debts with Midland they can or will not verify or remove. Consumers have very little recourse.Experian Credit Report is the worst they continue to record debtverify-they only ask name and address of account.Midland also starts from date they purchase the debt. 7 year rule does not apply.

Hi Gail
Welcome to the forums.
I suggest you to contact the FTC if you do not get results of your dispute placed with the credit bureau. The CRA is required to probe into the whole matter and give you the results of the investigation done. You should get results within 30 days after placing the dispute in writing. Contact the fraud department of the bureau for immediate response. Also, do your correspondence through certified mail with return receipt requested. You will have all the dates tracked for proving your side of the story.
If the bureau still puts the status, 'debt verified' in your record, you can show the proof of being a victim of identity theft to the FTC as well as the attorney general. Your case will get strengthened.
Please let us know after you hear the results from the bureau.

midland credit problems
I had the same EXACT problem as "faithbarbie" with Associates. Now Midland credit is calling me and trying to settle. Apparently when Midland acquired the debt from the Associates it began to acrue interest because the amount they are stating is $700 more. I agreed the other day to make a $50 payment for a future settlement promise of 40% of the total amount now due. My question is since I agreed to make a $50 payment do I still have the right to dispute this? This account is over 8 years old and was only a maximum credit limit of $500. What can I do?

Hi klevr3113
Welcome to the forums. As per the state laws, the statute of limitations for legally collecting the debt might have expired in your state. Please let me know the name of the state where this account originated so that I can further comment on it with surety.
There are two things that renew the expired SOL period. A payment made to the account that is already out of the SOL period restarts the statutes from the beginning. Also, a written agreement to pay the debt to your lender is also considered to activate the SOL period.
If you have agreed to pay them in writing or if you have made the agreement orally but they have your voice recorded, your dispute won't be valid.
Please let me know your response before I can suggest anything further.

In Texas, the debt is out of the SOL period after 4 years. So, you can place this dispute on a valid note.
Now, since you have agreed to pay them, they can take legal actions only if they can prove your consent given on it.
I suggest you to write a letter to the agency and ask them to send you the details of this debt in writing. After they have sent it, place it on dispute. Keep a follow up. Send your letters certified with return receipt requested. You will cover your bases. You are secure till the time they have not taken any legal actions. It is because they don't have the proof that shows you have agreed to settle it. If you are charged legally, ask them to prove it first and settle the matter outside the court. This works..

i have never had a credit card in my life and when i looked on my credit report i had a past due account with midland credit through associates. when i first checked this a couple years ago the account was closed and a little over $1000. i called to inquire and let them know that my identity might have been stolen (my social and ID were lost prior to the incident). they told me that i had the credit card and i had to prove otherwise for them to do anything about it. i told them that i had nothing to do with this account and i wanted it off my credit but they refused. over time i didn't hear anything back from then so i completely forgot about it until i had to check my credit again. this time it shows the account reopened and at close to $2000. how do i dispute this when all i can find out about the company is fraud and ripoff reports?
