I recieved a call at my house last night wanting to settle for $500 on a $300 loan that was started in 11/05. (And that was a discount she told me as I owed $700+) When I asked for validation, she told me to go on line to the payment history. I had looked at this before and you can not tell the amount borrowed or interest and fees because there was advances on the amount. When I asked her if they were licensed in the state of Ohio she told me yes I had the load didn't I. I don't remember seeing them as licensed. I gues I will try figuring out how much was borrowed and repayed as well as see would owe any additional amount. Any suggestions? I have sent emails asking for validation and a copy of the state laws but have not received a response. I sent them with a read receipt so I know they were received.

Lanita,

Check the legal rates in your state at the link below. The total amount of interest and fees on the principal amount must be according to the laws revised in your state. Ask for your loan statement from the company for reviewing the details and then make further payments if you owe a balance.

Unfortunately your states' AG onlyl files those complaints away until a large amount of the population files against the same company.
This is the same for the FTC...I received a reply from them on a pdl's unscrupulous collection activity.
Everyone must file complaints with their AG and keep on it until you get a reply...that will be the only way we can get their attention, I'm afraid.

I filed with the AG's office via email because at least I know it was received. The response I got was they would respond within 90 days. Seemed like a long time to me. I had asked for debt validation from PaydayOK along with the amount I borrowed and amount I had repaided. My response I keep getting is go to account history and look. I guess I will try to figure the mess out! I have decided since they don't want to give me an anser, I will figure it out the best that I can and apply the interest for the state of Ohio and go with that as they don't want to give me an anser besides their amount with all of the fees and interest. I know I have paid more than enough and I don't get an answer from Ambassador or Access. Magnum and Check into Cash were more than willing to either come up with a settlement or mark paid in full.

Lanita, don't pay the lenders any more money if they ask you for it. Tell them that you have sent your complaints to the AG's office and they will be clarifying the debt account on your behalf. If you sound legally right in front of your lenders and have the backing of your AG, the lenders cannot try to intimidate you and take extra money from you. You have to cover your basis with the legal approach. Ask them to give you the statement of your account showing down all the payments done in the past.

I don't plan on paying them anymore until they will tell me what I have paid. The one that called me told me if I wanted to know look at the account history. I would think they would have that information to give you. I asked if they were licensed in the state of Ohio and she stated "yes, you got the loan didn't you" When I asked for the license number she quickly told me the balance and hung up. They can't take more money because I asked 5/3 to close the account and they told me they couldn't until it was a zero balance, I then asked them to not honor the withdrawals and they told me they could not. Finally, when I had my direct deposit changed and it finally reached $2,100+ in bank fees, they closed the account.
