I have received a judgment summons for the local court for an old credit card debt with last activity in 1996. The court is requiring an anwer be filed. I have sent the attorney the file had been sold to and the original collection agnecy and also the court a debt validation letter. I would like to know what I need to do now.

Did you send the SOL expiry notification to the credit company? If the letter has been sent in writing, you have already done most of the job. You can prove in the court that you contacted the company using your legal rights under the fdcpa. You should file the answer to the court. It must be done first to honor the court order. Then, you can explain your point.

I received a summons for a credit card. It says I have to write an answer to the attached Petition in Court within 30 days. I assume I write why I haven't been able to pay? Is that all the information I'm supposed to give? Is it best to suggest what I can pay them in the letter? Do I receive a court date once they've gotten my answer? I can't afford an attorney will I go to jail if I show up for court without an attorney? What should I have with me when I go to court?
