If they have validated the debt, explain to them that you don't get paid til next week and then you will send payment by money order, certified mail with return receipt.

well basically i worked out a payment with them. Then another company called me yesterday at work and said i needed to pay them 155 by today or they were going to take legal action. They told me what loans i had out with them and the one i don't remember taking out. What will happen if they take legal action? the woman on the phone wouldn't tell me what would happen, but i didn't want to find out because i was a repeat offender. someone please help me figure out what to do. i don't want to be sued, but i don't know what else to do.

Amanda, when you say another company calling you for the past loans, I assume it to be a collection agency. Most of them are famous for their notorious collection activities. More often, they don't even have the complete information about the debt they are collecting for. Throw a debt validation letter to the CA and force them to validate the debt. It is under your legal rights and without this info in writing; you are free not to pay them anything until they prove their genuine collections. The CA cannot file a case in the court unless they have purchased your account from the original creditor. Most of the times, they are hired by the OC for collections. If they fail to recover the money, the file is sent back to the loan company who decides their further action if a court case is necessary in your situation. There are court costs and fees attached with filing of a case. Try to deal with the original company with whom you have the loan. If they accept your payments directly, you won't have to deal with the CA.

Wages are garnished if you are unable to meet the set payments. Remember, this is a civil matter, not criminal. Making jail threats to recover the debt is illegal. Don't get scared and make wrong decisions. Report them to the FTC, BBB.

Don't panic. When a company says they are moving forward but do not explain specifically what steps will be taken, then they are probably not going to do anything. If a company is serious about legal action, they will provide the details of the process which is about to begin. Stand your ground and propose a payment that you can live with. It should be at least $75 a month and you must then stick with it. If you come in with a figure like $20 a month, that will likely be rejected.

Govt need to know from every constituant in there territory that this greedy way to take advantage of the poor people who keep them in govt. If more of us start at the top maybe we can run them PDLs out of business.
