Outstanding PayDay Loans - Ohio Resident

I have outstanding payday loans and in the process of trying to work with Take Charge America for my credit card debt. I don't know what to do. TCA cannot work with payday loan agencies and since I have no positive income coming in I am barely making ends meet literally. Are there any places that work with them. I am robbing Peter to pay for Paul and do not know what else to do. My checking account just became overdrawn and is -($324) and additional pdl debits are coming up next week 9/30/06 and I haven't even paid some bills as of yet due to no money. What can I do? Do I close my check accout and open a new one once the fee is paid hopefully before 9/30/06.
Here is the list of payday loans I have and what I have paid out so far. I can't believe I got so caught up in these because I was trying to stay afloat and my credit is so bad that I could not get a loan out to pay my credit card debt since I was off of work in the beginning of the year and now it has just spun out of control. I kept renewing the fees just to have money left over to pay other things like gas, home phone etc....I do not know what to do and any advice would be greatly appreciated.

I do not want to file bankruptcy but I do not know what other options I have considering I have other debts but I know if these PDL's were gone I would be able to get back on track. I have called some of my credit debt and they are willing to work with me but these pdls are what is preventing me. :(

Do me a HUGE FAVOR. Go to the OH Ag's site and file your complaints against each and everyone of your internet pdls. PLEASE. They are not licensed in OH. Right now the AGs office is getting a number of complaints from consumers on this site and it will help if more people come forward! You need to use the template letters on this site and insert OH pdls laws in them and send, fax, and e-mail them to your internet pdls. I have had success in getting one of my pdls marked paid in full and I am waiting for response for the other 4. I can see that you have paid more than the legal amount allowed by OH law in interest. Please file your complaints.

Explain to her that you are willing to pay the prin balance and than want account marked paid in full and give her a date that you can pay it. She was very great to work with and marked my account paid in full!!!

I would also either close your checking account once you clear the overdraft and re-open a new one, or talk to your bank about blocking debits to the account. The only down side to blocking the debits is if one of the pdls gets cute and submits a paper check, which the bank won't know to block. You could try talking to your bank and explaining your situationn to see if they can offer a solution.
Many of us on this forum have been and are currently in the same situation as you. I can't speak for others, but closing my account was the only way I was able to take control of my paychecks again.

I also closed my bank account to stop the debits, and then I sent out the template letter asking for my accounts to be paid in full. I had well overpaid on all of mine, according to my state laws. I had 7 PDL's at that time and have had 3 send me emails showing my account as being paid in full, I even received a refund from one of them. Another 1 has told me over the phone that my account was marked paid in full, although I haven't received anything in writing yet. One hasn't made any contact with me in the 4 months since I first contacted them, I am still sending them letters asking for my account to be marked paid in full. The remaining two, Nationwide Cash & Rio Resources have tried to demand payment, although I haven't heard from either one of them for some time now. It has been a HUGE relief to get these off of my back and be able to have control over my money again. It takes a little time, but is well worth it in my opinion. You will just have to keep sending the letter until you get some response.

I don't know what Ohio laws are, but it definitely looks like you have paid well over what you should have on at least 5 of your loans. You will just need to insert your state laws into the template letter and start sending them out. I am sure someone else on this forum knows what the Ohio laws are and will help you out.

File a complaint with the AG's office and do it online, they told me that is the best and quickest way, they get it immediately whereas if you mail it in, it will take awhile to get to the right party for review.

What are my options concerning the pdl's that are new no money has been paid to them and they are to debit this coming Friday, 9/30/06. I closed my checking account as many of you suggested and was the best solution that is associated with the pdl's but am not sure how to approach the ones that have not been paid such as:
1.) MTE Financial Services, Inc dba Pay Check Today/ recent $390 / $90 due 9/30/06 - nothing paid thus far
- I used them in the past and always paid
2.) SGQ PROCESSING / loan $250 / finance fee $75/ total amount due $325/ $75 due 9/30/06 - paid nothing thus far
3.) Payday OK of Delaware, LLC dba PayDay OK / loan $250/ paid $191.43 thus far / total due $282.14/ $80.36 due 9/30/06

I did not give this company my checking acct. no. I don't know how this company deposited 200.00 dollars in my acct. I don't know how much finance charge or anything! It scares me to know that these poeple have my checking account number! I don't even have a phone number or address to contact these poeple. If someone have a phone number or address, please reply.

What is the name listed on your bank account? It should say who put the money in your account. See if you can find that out and we may be able to help you figure out who it is. Many of these pdls go by one name and when they go to debit your account it is by another name.

Is there a number on your bank statement for SGQ Processing? I recently defaulted on a loan with them and am trying to work out payment arrangements with them but they are hard to find since they do not have a website etc. I referred to one of their emails and found contact information, check to see if this helps.

I called to get the amount i still owe on my loan and no one has called me back yet. they continue to take thirty dollars three Xs in one day, every other week. I think i over payed. And the loan was only 150.

Unless you pay the $150 plus the $90 finance charge for a total payment of $240, this company will keep rolling over your loan and only taking the finance charge of $30 every 2 weeks. I'm guessing the reason they split the $90 up into 3 debits of $30 is in case you don't have enough funds in your account, and they are hoping at least one of the debits will go through.
If you tell us what state you are in, someone can provide the state payday lending laws for your state and you can figure up how much you have overpaid on this loan according to your state laws. The next step would be to either have your bank block all debits from your account so this company can't get any more of your money, or if they won't do this, close the account and re-open a new one.
Then, you'll want to send this company a letter via certified mail/return receipt requested, advising them that you have overpaid your loan by $______ and want a refund of the overpayment and or your account marked as paid in full. Also advise them that you are hereby revoking ACH debit authorization on your checking account, and no future debit attempts will go through.
You'll also want to include your state's payday lending laws in your letter, so you can inform them as to how you came up with the amount you have overpaid. If you need help drafting the letter, just let us know, there are many people that will be happy to help you. Also, Polly, another forum member, has a template that you can edit and use to send to the company you have the loan with.
