I just got he harrassing phone call at work today after speaking with a Helen Downey 2 times and letting her know that I will pay half of the $820 this friday on payday and the next half 2 weeks from Friday and she told me that she would talk to her supervisor and see what she could do....then today I got a call from some lady named Lisa threatening me wage garnishment and asked why I couldn't pay the whole amount and I said because I have other bills. She then just kept belittling me and I finally broke and hung up on her. Now I am sitting at my desk in shaking & in tears and I don't know what to do. Please help!
And now they have contacted my HR dept and emailed them too.

You should probably send them a cease & desist letter, as well as a letter stating your revoking the wage assignment. If you're willing to pay this, state that in the letter.
How do you know they contacted your HR? Wage assignments are totally voluntary. So you should probably inform your HR that this has been paid, and that you've already revoked the wage assignment.

In the letter below they state that I am not willing to work with them yet I have given 2 dates that I would pay the total. They won't give me information for Western Union or Money Gram. They can still hit your account, even if your employer agrees to wage witholding.

Basically, you don't want your payroll to allow CTC and debit money from your account. You will have to explain this situation to your employer so that they are alert when CTC tries to do a debit. You must also send a wage revocation letter to the company and a certified copy to your payroll. This revocation letter will stop them from doing any sort of activity in your account. I will ask the same question that Mikey asked. How much is the actual loan taken and how much have you paid so far? Which state are you in?

I have already closed my checking acct so they can't continue trying to hit it because it's no longer open. They don't have my new acct # and never will. Now I am just trying to figure out how to pay the 2 payments and know that once I have paid the full $820.00 they will quit harassing me.

Have you tried speaking to a supervisor about this issue? Was there a good reason for you not to pay on time? If you're cooperative with them, perhaps they can wait till your next pay period.
I would suggest penny pinching for awhile. Somehow make your budget work. Eat simple for awhile. But do not take out another payday loan to cover this one. It won't work.

Does anyone have the information to do a Money Gram or Western Union. I just want to get this taken care of. Granted I still am going to continue what I told them of paying 2 times (once in 10/20 & the other half on 11/6). They can't use their so called recordings against me because I told them that was my plan that is what I am going to carry on and do. I figure by the time they were to "maybe" send my employer a wage garnishment (which my payroll told me won't be valid with out a court order and the contact me before they agree to it) I will have them paid off. She tried telling me that it is going to go against me on my credit report. I used to do collections, then can send it but I have 30 days before it acutally affects my credit score. Leesa didn't like hearing that I knew the collection laws. I used to be in that field. She just got to me because I didn't have my guard up. I won't let her do it again.

I have also typed my revoke letter up and will send it first thing tomorrow morning by priority mail, requesting a receipt. I will also forward one via fax & to my payroll dept. Thanks for everyones support, I just let my guard down today when I thought I had my self syked up to deal with these animals.

I live in NC. They did send my employer a volunteer wage assignment. My employer took 434.00 from my paycheck. the person that is in charge of garnishments told me that I couldn't revoke the wage assignment until they sent a letter stating that it was paid. She said that they sent a copy of the volunteer wage assignment with my electronic signature. I contacted her supervisor. I was told that they had not sent CTC a check, yet. I could have the money put back in my account or they could send them the payment. I agreed to have it sent to CTC. They were also calling CTC to let them know that I agreed to let them take the amount from my paycheck and they would not be doing volunteer wage assignments anymore.

You needed to send the revocation letter to CTC as well as to your payroll dept. I say, send one letter now and insist your payroll not to allow any further debits. Find out how much is the actual loan amount and how much has been paid on it. You are supposed to pay only if there is a balance. Find out from your state laws for the legal charges.
Digital signatures must not honor a wage assignment. This is illegal. It has to be approved with your signature on pen to paper. This might be another illegal activity done by CTC. Go to this link once.

Tell ya what, my mind is spinning from the amount of differing information I have read about this company.
Regarding the wage assignment:
1)They will (or will not, I am not clear) continue ot hit my bank account every pay day, 4 times after "default", to collect?
2) I faxed them and my HR department, a letter of revocation both of Wage Assignment and also Authorization to do ACH debit, but they will still hit my bank account, 4 times?
3) After the 4th attempt, they will attempt a wage assignment, even though I have already faxed the letters?
4) After that, what happens if they have still not collected the full amount?
Please, would someone kindly answer these questions, in order if it's okay? Everytime I feel settled I see more, and different information. I just would like a timeline of how they work that collection, from "default"

Unfortunately, anything can happen if an illegal company is after someone. But a company with legitimate business will never break the laws and go against consumers' requests. You have to take any necessary step and block CTC from debiting in your account. If required, go to your bank and talk to your payroll about your situation. They may be aware about CTC and will be cautious when one tries to hit your account.

I haven't been contacted by CTC or Ecare (their 'military' wing, lol!) since I sent the letters. This Friday, tomorrow, will be the first payday since the letters were sent. My Payroll lady will notify me when and if they decide to try a wage assingment, then I will know what's next I suppose.

I do know that CTC will attempt the wage garnishment, it's good that you notified your HR dept. I didn't have the problem with them repeatedly attempting to ACH my account. I put a block on each of the copanies, but my bank eventually suggested I open a new account because of all the dba's they go by, I didn't know all of them. I have heard of them sending the accounts to outside collection. But there is the chance that you will never hear from them again as well. Did you file complaints with your AG's office. I did and some settle my account as paid in full, that was just over 2 months ago and there are 2 that have never contacted me since my default and the AG's office contacted them. You can pretty much count on CTC trying the wage garnishment trick, but your good as long as you notified your HR and sent the wage garnishment revokation. I hope I answered a few of your questions. I guess what I am saying is that, you may never hear from them again, or they can make multiple attempt to debit your account, or they may send you to outside collections. All of the scerios are possible. I would definately open a new account, that will at least set your mind at ease with that issue. You will start to feel better about things after some time has passed, I know it is scary in the beginning with all of the horror stories, but you will be ok.

Mind you I am the one that started this whole thread, but you don't know how good it felt today to get my whole paycheck in my checking account. Like I stated in a couple threads above I will pay CTC off and others, but unfortunately they will have to settle for how much I can give them at a time. My HR said they would contact me "if" they even receive anything from this company, because a wage garnishment must be in the form of a court order. Anything else they discuss with me and since I told them my arrangements that I intend to have with this company they wouldn't even get in the middle. Keep all receipts if you can.
If you do open a new account, don't pay these back with a check or debit card. Make sure these companies give you Western Union (or) Moneygram info. Don't let them get any more information then you already have given them.

We also had a pdl with CTC. They were very very harassing, calling work, supervisors, co-workers, friends, and even someone where I work who doesn't even know me and isn't even with the same employer as me. They tried to do the wage assignment threat with me, but I revoked and also let my HR and boss know.
We tried very hard to make payment arrangements, but they refused. They did give us Western Union info, but they said it had to be a full payment. After doing so more research, I figured that was too risky as they could get the money from WU that I sent and then still go after my bank account for more. I think this might have happened to someone on this board.
Granted it was very embarassing, but they were getting way out of control, so rather than let it continue, I had to say something. My employer was very understanding :D
Surprisingly, that's when I learned they were not licensed to lend my state. I also read up a lot on my rights and they were definately violating them.
Not real sure, but I believe it is illegal for them to have "irrevocable" wage assignments, think the FTC may have made those illegal.
I reported them to the FTC and informed of that and I also let them know I discovered they were not licensed in my state.
Since then, we've heard nothing from them anymore...it's been almost a month now.

I know I am the one who started this thread, but I knew how much I owed them so what I did is said I will pay $410.00 on 10/20 & the final amount of $410.00 on 11/3. I paid my first part this past Saturday...had to find a moneygram place thought I knew where one was. Then today I got a letter from CTC saying the received my payment of $410.00 and look forward to recieving my final payment from me of $410.00. But during these payments they are in no way recieving any of my new checking account #. This is just to help you out. I hated having to change my account but I couldn't stand the thought of these companies to keep debiting and not make arrangements with me. I just want to become PDL free & I am on my way to that. Well I have a long road ahead but have paid of 3 so far and this one will make 4.

Original creditors do not have to follow cease and desist requests, that is only the outside CA that have to follow the requests. They are however forbidden to use illegal threats, etc...to collect a debt.

I have dealt with them also, and never had a problem. (Well, actually I had a stupid personal problem obviously if I needed the services of a payday loan company - LOL).
They state clearly in the agreement that you sign before you take the loan that it must be paid in full when it comes due, that there is no "paying it off" over time.
I even said before doing it "So, if I borrow $500, I have to pay the full $635 in 2 weeks no matter what?" And they said yes - they didn't try to fool me or tell me otherwise. So I knew not to do it if I thought I wouldn't have the full amount in time.
They did say you could immediately take out another loan the same day if you need to, but there is no carrying any loan past its due date.
I am not trying to stick up for them, because they do charge highway robbery in interest, but terms are clearly stated.
