Sharon Williams, Account Manager/Reconciliation Consultant, Westbury Ventures sent me an ugly email yesterday. I have asked for a statement of my account and needless to say haven't heard from her. I quickly informed her that payday loans are illegal in the State of NC.

I need some advise. I received a loan from Xpress CAsh(Westbury Ventures) and have paid over 1,000. I stopped them from taking any more money from my account. They tried under two more names, but I was able to get my bank to refused to transfer the money. How do I get this stopped. I have told them that I do not want them to take anything else from me and that I have made in well more then my share. Who can I contact to get this stopped asap. What do I need to tell the lady who emails and calls me daily?

Lisa from NC

At the time I took the loan out I had a great job, however being a single mom with a crzy x I had to catch up on the financial ruin he put me in.
Shortly after I was hospitalized and put on disability although just to get disability that you actualy pay for through your employer takes 3 months, not to even mention everything else. I am even out of money for cobra benefits. What Do I Do?? I had every intention of paying this loan off

I didn't read through all this post, but you need to contact Brad Weathers at (800) 859-6439 ext. 234. He runs Westbury's Collection. He is actually a pretty reasonable guy as long as you know what you are talking about. The problem with this staff is that they are bullies, but they don't know their ass from third base. Very amateurish.

In all seriousness, Brad is a good guy and if you cite the fdcpa, the PDL's lack of a license in your state, permissible interest rates, etc. he will be fair to you.

LOL, Brownsugar. I was just about to make a thread about Bass and Associates. Nothing earth-shattering but it will be up on the Collection Agency forum in a sec.

All I know about Payday Avenue is they are one of the many ECare PDLs, and their in-house collections is entirely Canadian at this point, as is all their staff. From what I have heard, their in-house collection staff is completely undermanned, they have experienced way more defaults since relocating to Canada, they are using Universal Fidelity for their outside collections (Universal is terrible), and when you combine all that with their legal trouble in Canada, I can't imagine Payday Avenue has much of a shelf-life left.

I got an email like the one above and called to ask for a statement and got the same bad answers. Only this guy Ronal Reynolds got my work number and has started calling me at work and screaming at me and calling me ignorant and telling me I am going to be brought up on charges of fraud. I don't even remember getting a loan from him. Does anyone know about the laws in California? I will take care of this if I owe it, but I just want a statement.

thanks

I have been receiving several emails from this company. They also said that I took out a loan for $300 from 2003 and now I owe $1200. I asked her to send me any information that proves that I took out the loan, and Chelsea Keitle said that she will mail me an invoice but sending me my original contract would be a waste of her time. Does anybody know who I can contact to stop these emails from coming?

I received at least 12 threatening e-mails from a William Smith at DMS Marketing. Last year, a Malena Bunch sent me a letter requesting payment on this loan. I spoke to Ms Bunch on the phone. I paid the ENTIRE $500.00 and got a REFERENCE NUMBER from Ms. Bunch.
I sent ALL this info to Mr Smith but I continue to get threatening e-mails from him. I have the bank statement showing the $500.00 payment.
HELP.....I do not deserve to be harassed like this!

I also have Westbury Ventures on my back. I have stated to them that I will only communicate with them through e-mail. I get e-mails all day saying that they have my SS# number and will track me down. I have tried to make payment arraingments with them but am hestitate about giving them my Master card number. So I thought I would do some investigative work on this company and now am glad I did. What do you suggest I do. I live in TN.

You will want to send them a letter revoking voluntary wage assignments in case they try to use that against you. Send it to your employer, also. Have you closed your bank account associated with this loan? I am currently being threatened by this company as well. You have come to the right place. There is lots of help and emotional support here!

I have a problem with one of their employee name Ron Reynolds--Bad Check Recovery Supervisor....He called my job and reported that he was going to file charges against me for defrauding his company. He also called me IGNORANT. And he stated that after his is done with me I will be owing his company $4676.00. I have three different payday loans. And due to back in November 2006 I had some fraudlent charges done by another compnay that took money out of my account without my permission. So I accured alot of NSF Fees from my bank. I contacted Beter Business Bureau in West Florida. And the outcolme of that was. I did not get the money that is owe to me. So my bank closed my account due to all of the NSF FEES that added up. Can someone email me with some advise regarding what I can about this company. My email address email address removed as per forum rules - Mike

Thank you for the information. No I haven't given them any card # or bank #. Yes I have closed that account. They have already threaten me because they said that they have my SS# and all my personal information to use against me. I emailed them this morning and told them that I had done some research on their company and I was not going to give them any card #. I also ask for a print out of the total amount owed and, that I was not going to pay anymore than what I borrowed. I will send a letter revoking wage assigments. What is that for, in case they try to garnish my wages. They would need a judgement for that I thought. this was so long ago I can remember but I think it was 200-300. I have not payed anything yet. They have said in a round about way that they can press criminal charges against me. I told them that I did not take to threats very well and if they wanted to do that then quick bothering me and go ahead. these people make me so mad. I know that i owe the money and want to pay it back but I don't like the harrassment. Plus all their emails come in my bulk mail and I don't read them I just delete them. I told them to contact me through my inbox and from this day forward if they continue to spam me then I will not get their correspondence. It is great to have this support out there. Thank You so very much.

I have been fighting these people for a while now -- well, not that long, but it seems like forever. I have even changed my phone number to an unlisted one forcing them to contact me via written means.

They don't like that.

OH WELL.

And I work from home --
-- and I work for a Uni and the payroll does not honor any requests for any information/garnishment from PDL.

I am lucky in that regard.

Now I can just harrass them back 'till the accounts are marked PIF.

hold your ground & know your rights!!

Well I just shot off a letter to them rtevoking the voluntary wage assignment. I have printed out all emails from them and myself. they don't have a phone number on me because I don't have a phone plus they can't get my work number because I work through a temp service. I still have not gotten anything paper work on this loan stating hoe much I owe.

Well now this guy Mr. Featherston is wanting me to sign all these forms that are suppose to be noterized.
I just shoot them right back. He tried to say that because I have been opening up his spam mail that if I stop doing so then I will be refusing. I told him that it was my decision not to open my spam mail and that I had told them in the beginning that I don't open it. I said that if he does not email to my inbox then he is refusing. I have told them how to get in touch with me. He also stted that now there will be more charges added on to my account.

I got this email from Westbury, I'm in NC also:

Quote:

I am contacting you because you have one or more payday loans that have gone into collections. I have made numerous attempts to get in touch with you regarding repayment of your account(s). Since you have demonstrated an unwillingness to voluntarily settle the debt, you have been referred to Check Recovery. This automated system is actively looking to locate any valid bank account associated with your name and social security number. If such an account is found, Check Recovery will move to recover the entire balance due at once.

If you would like to have control over how and when your loan(s) are repaid, please contact me to put a firm payment plan in place. If I do not hear from you by close of business April 20, 2007 will assume you would rather have my company take back what you owe rather than paying it back on your own terms. You may contact me by phone, fax, or email.

Thank you in advance for your cooperation.

Then I emailed him back and said:
Quote:

You can not 'take' anything out of unauthorized bank accounts, without a court order. Especially since you're doing business ILLEGALLY in my state, of NC. I have printed this email, and will be filing a complaint with my state's Attorney General. In the future, all communication must be sent through the Postal Service.

Thank You.

He emailed me (marked urgent) back with:
Maybe you should read the contract that you agreed upon when you asked for the loan.

I know the PDL people are stepping up their efforts bc it's tax time, and they're trying to hit up people as they get their returns back, but he can't seize any bank accounts, can he?

I am so scared. I am in TN and I am going through the same thing paying off this loan. I had two loans with them. I paid one off, I paid approx $500 more than what I owed to get that paid off. And the other loan, I have already paid extention fees, plus $250, and they say I owe another $590, and it is adding up daily. HELP. I told her the TN law, that I had contacted the Attorney Generals office, her response:
#1 we are not governed by state laws. #2 the extension fees paid are just that EXTENSION fees, they do not apply to the principal.

I requested my documents, and she said:
I will try to take time to find the signature but that is the only "documentation" there is. There is no documentation previously than what
was deposited to your bank on the fund date. EXTENSION fees do not count as payments. I am willing to settle the difference but it will not be less than the principal loan amount on the account. By prolonging this you only cost yourself more in the end.

WHAT CAN I DO? I HAVE TWO KIDS AND NO MONEY LEFT, I AM SO SCARED.

jenni, if you haven't done so, close your bank account.
These companies are governed by the state laws. DOn't let them tell you otherwise.

A few of us are fighting westbury, and their many DBA's. Stand your ground, follow through with your complaints. They are only going to get more aggressive, you just have to be persistent.

Ok...I wrote them a nice long email yesterday stating that I had paid them the amount in full (they put my account -600.00. I closed that account.) They have since then continued to harass me regarding the money.

So...I emailed Jamie Bailey, my contact person and told him that his emails were illegal, in direct violation of the Fair Debt Collections Practices Act, and that if he continued to harass me, or to call my work, I would have a formal cease and desist letter drawn up by a lawyer, and pursue full any and all legal action against them. I haven't heard back since-and I sent that email at noon yesterday. So we'll see what happens. I think the only way to fight this company is to get right back in their faces and say "Get lost, jerk. I KNOW my rights, and I am NOT going to let you violate them." I notice these emails tend to prey on the uninformed. Take that power away from them!!

here is the letter that I wrote-if anyone would like any ideas. I think that they are figuring out people aren't going to put up with their crap. For my own information, does this Westbury Ventures pretty much do all the payday loans available, just with different business names?

Here is the letter:
Quote:

Jamie Bailey

This is to inform you that you will immediately cease and desist your threats of collections against my accounts. I have had the balance for my payday loan debited before from an old checking account, and I am NOT going to pay another penny over what I owe. I am also reporting your company to the state Attorney General's office, and forwarding copies of all emails you have sent me thus far. You are using illegal, underhanded, threatening tactics, which is in direct violation of the Fair Debt Collections Practices Act.

You may contact me at this email address: I WILL NOT engage in any sort of business negotiation with you over the phone, because I want everything documented-your blatant disregard of the law set in stone should anything further occur.

This is my last warning to you: I have paid that debt in full to the company, well over what the laws of my state of residence, Oregon-requires, and I will brook no further harassment from your debt collection agency. If you do not CEASE AND DESIST immediately calls to my place of employment, and your threatening, illegal emails-you will be receiving a cease and desist order from my attorney, and I will take any and all legal action possible to not just rid myself of you, but to shut your debt collection company down, permanently.

This is a last warning. Cease and Desist your actions immediately.

I think I am about to do battle with this company soon. I have a loan through VC Funding, which I think is part of this scam. I DO owe them money, but do not know how much. I know the loan was for $250.00 and my bank statements show that I have paid $150.00 in renewals so far. That means I legally owe them $100.00, since rollovers are not allowed in FLorida. I have since closed my account with my bank and have opened a new one. They did send me a contract that I did sign, but I have misplaced it. I am sure they will be calling me and threatening me pretty soon, which kind of scares me. They seem like real jerks!

VC Funding is part of Arrowhead, which means you'll probably be hearing from Bass Prelitigation. (Arrowhead will try to collect themselves for a while, but they leave the heavy lifting to Bass.) There's some interesting developments in the threads on the Dealing with collection agencies page and in the Pub. Someone found a reporter in Jacksonville that's looking to expose Bass. You should check it out.

Ok, Help on this please? Is CMG Group (internet payday lender) , LLC, and Westbury Ventures licensed in Oregon State??? Any help would be appreciated! had a call from "Joe" from Westbury Ventures, collecting for CMG Group (the payday loan people) I immediatly started asking "Joe" questions about validating the debt, and at no time did I give him the opportunity to threaten me. I asked for debt validation, asked if his company was licensed in Oregon, asked if the original payday lender was licensed in Oregon, told him I would be calling my state rep, and he seemed fine with all of that. In other words, this forum has helped me learn how to talk to these collectors, and have them back down. he said he was from the fraud recovery dept, I told hiom there was no fraud, so he could send this account right back where he got it. I told him to validate the debt in writing, and asked for a mailing address to send the payment, he said there was not one. Once again, I gave him a zero opportunity to threaten me.

I am also looking for where they are licensed. I have filed with the DE BBB based on their phone number but see many different possible areas they could be licensed.

I am receiving threatening emails from Garrett Kenyon about 3 outstanding loans. I have takenloans, but don't recognize their company names and the amounts they want are MUCH higher than I applied for.
He has refused to send me a statement, copies of my loan documents or proof that they are registered in Utah (where I reside) which I have strong doubts that they are.

If anyone knows where the best state to file with the AG, please let me know.

Thanks
Melissa
