I don't recall signing anything that indicated Wage Assignment was possible.
Sad thing is I thought they seemed like a decent PDL company, so I chose them.

Send or fax them a letter in which you revoke the wage assignment. Make sure you send a copy to your HR department. The wage assignement is voluntary from what I remember. Check your state laws because they might need a court order before they can garnish wages. I am sure they will not get a court order since that will cost money and they are lending illegally in most state.

According to Lone Star Legal Aid, the problem I may run into is that some HR departments may simply not know the difference and treat the Wage Assignment as if it were a court-ordered garnishment. A good HR department would notify the employee of the Wage Assignment that they received and make sure that is agreed upon. Of course, since the PDL will present the Wage Assignment to the employer showing a signature by you. So, your employer may just assume that it is valid and binding.
Also, an employer in Texas has no duty to honor the Wage Assignment even if both parties agree to it. Some larger employers will simply not honor the Wage Assignments without a court order.
Bottom Line for me is that I work for a company with a decent HR department. If the PDL threatens Wage Assignment, I will simply notify my HR department of what is going on and that despite any documentation that I have provided, I categorically do not consent to any Wage Assignment.
