For any debt issues, one can't be sent to the jail. The court will see if there is any way to work out something between both parties. If this is not working, judge will review your income, expenses and other necessary documents that give details about your financial standing. Usually, wages garnishment is done when there is no way of getting the money from the debtor. The laws vary in each state and the maximum amount that can be garnished is up to 25% of the disposable income. This means that money for your basic needs will be considered before a writ of garnishment is finalized.
