I am overwhelemed with payday loans and I am embrassed to say that I have 12 loans both internet and storefront. I need some advice on what to do because I have at least roll them 1 to 2 times, I jsut came to realize I can't live like this anymore. I need some advice on what to do. Should I close my account and start making payment arrangements. I am not eating or sleeping. I wonder what would legal actions could happen to me if I close my account. I live in the state of oregon. Please give me some advice.

Here is the link to your state's pdl laws. It doesn't state what if any criminal action could be taken. It does give a link for the regulator of OR's contact info. you can contact them to get reassurance. I highly doubt any unlicensed internet pdl is going to pursue charges, they often give this illegal threat to take more money from you, that is called extortion.

Today I was able to payoff 2 of my 12 loans and I have payment arrangement with majority of the other ones. I am starting to feel alittle better, however, I am stressing because I have a loan with Cashnetusa and I am wondering if they will be easy to work with.

Talisa, I am glad to see that you have registered and welcome. We all help each other here and we have all been in the same place you have been in.

Cashnetusa is a company which I have a loan with. Although I have them in debt consolidation, they are nice people to work with. They don't call to harass you or anything as such. Just talk to them. I believe that they are opened on Saturdays.

You have come to the right place.

Now between me and my wife we have 3 ipdl's. To the best that i can find none are licensed in Oklahoma. I have paid the principal on most. Now i ready in another post about the Zippo case. If that applies they are conducting business in my state taking money from my account her which means they would have to abide by my states laws, right?? Did i confuse anyone..lol

Hi John,

Welcome to the site! You are correct, any payday lender has to abide by the laws of the state where YOU reside, not where they are located. Many of the payday lenders will try to convince you otherwise, but don't fall for it.

Can you give us a list of the companies you are dealing with, and we can help you sort this out? Let us know who they are, the original amount of your loan with each one, and how much you have paid on each one, and we can offer some tips on how to handle this.

You'll soon find yourself on the winning side of these loans!

Go to www.paydayloaninfo.org and look up your state laws on payday lending. pay back the principal and whay your state allows in interest. Most important file those complaints with the Attorney Generals office. They want the complaints. The more that goes in the better. These predators need to be STOPPED!!! KYSIDE38

talisa - I would send the wage revocation in any case - some payday lenders are so far out there that it's not impossible that they would try wage assignment even if you made arrangements with them.

Here's a link to a previous thread on this site that relates to wage assignment. There's a good example of a wage revocation letter on that thread, in a post made by one of our Moderators - Roxette:

Talisa, if this is a storefront they are probably going to take you to civil court to get a judgement to garnish your paycheck. Have you tried working out a payment plan with them? Storefronts are licensed and I haven't seen any that use the voluntary wage assignment in their contracts because they are licensed and can go to court to get a judgement should somebody default and not make arrangements to payback the loan.

Ta Lisa what state are you from? I am filing several complaints with the Pa attorney generals office, plus the state that the lender is licensed in. Most of mine are in licensed in Delaware. I am sending a copy of the complaints along with Pa law to the payday lender making them aware of the complaint. They are predatory lenders. I have paid off 3 so far still have a few to go, the ones that are left are really getting under my skin. Hanging tough though.

I am starting to feel a little relief with the payday lons. T&C has been great so far in handling all of my payday loans. I do have a question to ask, since majority of my lenders are accepting my proposal from T&C should I still do a wage revocation to each lender? Thanks again for all the support from the form:)

Ta Lisa:

I remember when you first came on the message boards like me and how good it now feels to be rid of debt. Have you sent out that wage revocation yet? You need to as soon as you can. I am working with T & C too and one company, Ten Dollar, refused to work with me while I was with T&C but recently I was able to settle my account with them.

I am happy for you and I hope that we both have more success this year. Tell me, are you like me and are able to buy a new pair of shoes and groceries?

I have not sent a wage revocation letter yet, because majority of the pdl are working with T&C. I am still waiting to see what Checkmate is going to do. I will also have FastBuck paid off soon(YEAH)!!!

I do have a questions in regards to Oregon state taxes. As I start to celebrate to seeing financial freedom, my husband just recieved a letter that on his next payment they will start to gainish about 25% of his wages. Is there anyone I can talk 2 or what can I do to stop this from happening in 2 weeks. The letter was rude and not very helpful. This mean my husband's check will be a total of 500.00 short each month for about 10 months. Ouch this will hurt a family of 6 ( 2adults and 4 kids). Any advice will be very helpful. Have a bless day to everyone at the forum.

Cash Today AKA Cash Unlimited has call my job about 20 times today. They said they will not work with T&C because I wasn't with them when I took the loan out. They are asking for 500 on a 200 dollar I have paid 59.00 since this summer. I live in Portland and I think they are not license. What should I do????

It is necessary for all loan places to be licensed in the borrower's state before loan is given. Check the contract copy and compare it with your state laws. You need to dispute the charges if it's more than the permissible rates. Take the help of your state attorney general if they sound pushy.

No, from my understanding this company is not licensed in Oregon. It was an internet loan company. Can some verify this for me again. I am wondering if anyone have an fax or address so that I can send a letter to this company Cash Today. Thanks for any insight:)

I just found out the Cashnetusa sold my account to a third party collection. Can anyone tell me what is going to happen now and can they sue me? Also the company name is Collins, does anyone have a number for them? Please shed some on light on this matter. I was even wroking with town and country on this account. Oh, are third party collections easier to deal with? Thank for any suggestions or help in this matter.

Cashnet USA is licensed in Oregon, and if the thrid party collector is licensed to collect in Oregon, then they could potentially sue you.

It all just depends on the company . . . Most places aren't going to bother to sue for such small amounts, but some places will do it just because they are out to prove a point.

Talisa - Here is a letter I posted on another thread regarding PaydayOK marking my account Paid in Full, hope it helps - Quote:

Hello Everyone, Just letting you know that yesterday I sent an email to PayDayOK after receiving a 'past due payment notice'. Here is what I sent them -

Quote:
To Whom it May Concern,

Please mark my account PAID IN FULL. I have calculated my payments and I have paid back what I legally owe you. To date I have paid over $700 on a $500 loan. I have CLOSED my checking account you debited from because of some other unauthorized transactions. Please cease all communications with me and mark my account Paid in Full. If this request is not upheld, I will be forced to inform my attorney general of your actions and your illegal operation in the state of Florida.

Cordially,
__________

And here is what they sent me yesterday afternoon!

*THIS IS NOT AN ATTEMPT TO COLLECT A DEBT*

PayDay OK is sorry you are unsatisfied with its service. We will consider your loan paid in full.

Thank You,
