Wachovia Bank totally messed up

Every time I would call the bank and explain to them that those companies (Cash Doctors, Payday Loan Cash Now and Loan Shop) were already paid in full and they were not authorized to debit my account anymore. Every time I had my NSFs charges refunded by them. Well, last week, the same copanies tried to debit my account for different amounts and I called the bank like I have done in the past.This time it was different, because they told me that they had refunded me numerous times and they were not going to refund the NSF fees anymore. I tried to explain to them that, I have attempted to contact the companies by phone and email and did nto have any luck with it.
I even went to the bank and a lady manager told me that I had to fill out an ACH Dispute form in order for me to get my NSF fees refunded. That was strange, because when this issue started a couple of months back, I tried to do that and I was told that I couldn't do it because the debits did not go through therefore the form was not necessary. But this lady manager told me that I had to fillout a dispute form for every transaction with each company!!!!
I did that because she insisted, but I knew that it was wrong. Well, I waited and waited and waited and on Friday I called the bank and they told me that they were not refunding me anything and that Iwas wrong in filing those dispute forms!!!!
The nerve that they have to tell me that I did something wronng, when I did what one of their employees told me to do. This other rep. tell me, "Oh well, I cannot tell you why she told you that, because is wrong, and we can not refund you your NSFs fees anymore."
I told her that all that I was asking was for 4 NSFs fees refunded ($110) like they have done in the past. She declined the refund.
Now I have my account in -$1000 because I have been waiting for this stupid refund and it has caused a domino effect with my account.
When I get paid again on Monday, I won't have any money because it will go towards my negative balance.
I have asked them to close the account and that I will make payment on the balance, but they won't close it until it is $0.
What can I do now????

I think you should open a new account with some other bank and transfer your direct deposits there. This way, your paycheck will not entirely go towards the negative balance. Try to pay off the negative balance as early as possible so that you can close the account immediately. Keep calling the pdl companies and get the PIF letter. It looks like your bank will be of no help in filing a dispute with the loan companies and revert the charges.

I tried to stop the direct deposit when the charges appeared on the 18th and when I went to the bank on Monday (22nd) but the bank told me that it was probably too late. I was trying to open a new account with them where my direct deposit would go and then make payments on the negative balance, but they wouldn't do it. I just wont have any money for the next two weeks.

She was reviewiong my account with me and she told me, "Well, we have given you too many refunds already, now its time for you to handle it with the copanies." I told her that I have sent them revocation leters, emails, etc and they keep debiting my account. I told her that Wachovia didn't have any kind of constumer protection. I hate this bank!!!

Knock the legal places!! This is the only way you can make this bank back to their normal behavior. Inform them that because of their carelessness and consumer dissatisfaction, you are filing your complaints with the state attorney general and file a case against them in the court. Meet the bank manager and tell everything that happened in the bank. Assure him that you will be consulting an attorney after going out from the bank and meet them in the court. Let them know that you are taking charge because as a consumer, you have your legal rights protected.

Weeswie, thanks for the words of encouragement. I have already filed a complaint with FDIC this morning and it should be approximately 5 days before I hear from them. I believe the bank doesn't have a leg to stand on, because they have given me the refunds before, gave me the wrong information and are not protecting my rights. I will keep you advised.

Irhall41, good for you, filing with the FDIC. You gave notice that these company's were not suppose to be debiting your account right? If you did, then the bank is in violation of Regulation E. The acutal wording is on another of my posts. The next time you talk to them, throw that at them. It's time we take control of our finances and quit letting these banks and PDL's rule our lives!! Chizhy, I did mention Regulation E on my call today, but the lady didn't know what I was talking about. All she said was that Wachovia had refunded too many fees already and that they couldn't help me. That bank has a lot of people that are not trained in lending rules and customer service.

Anytime someone wants to revoke authorization, all banks are required to have them complete a dispute form. The form is then sent to the company being disputed (supposed to be anyway) and they have about 5 days to provide proof that they have authorization to debit the account. If they can provide the contract, the bank has to let the debit go through. Not all banks do not do this, however the one I used to work at did (as they are required to do) and we had many disappointed customers when their contract showed up at the branch and we had to tell them no. Is this what happened in your case? Did you revoke authorization? If you didn't, you should immediately to prevent further unanticipated fees.

This was done this week when I went to the branch and talked to the "manager".This is the same person that told me to fillout the dispute form when in reality I shouldn't have to do it. The bank is not training their personnel thoroughly and it seems like each one has different rules.

Sorry, I'm just really frustrated with banks in general lately and how they are just obsessed with the NSF charges. My bank charged me $33 for going overdrawn by, get this, $.05. FIVE FREAKING CENTS! and that cost me another $33 and of course they refused to refund it even if I said I can take a dime to my branch to bring it positive again.
I'm almost convinced banks are around to just cash in and use the NSFs to send their CEOs and branch managers on more than just 3 vacations a year.

Finally today my balance was out of the negative but just because it eat up my whole paycheck. I went tday in person to talk to the manager (one more time) and not only did he NOT talk to me, but he sent a lady to talk to me. Long story short.... she called me (not the manager) to tell me that the fees could not be refunded because they have done it in the past as a "courtesy" and they couldn't do it anymore.
I have filed a complaint with FDIC and let's see what they say.

Same thing happened to me with a different bank, expcept it wasn't PDL's, it was flat out identity theft. They wouldn't close my account, they said because it had to be a 0 balance. They kept refunded the NSF fees for about a month, then stopped. They then froze my good account with them, sent me to collections for the $600 in fees I refused to pay, since the transactions weren't mine and the bank shouldve and couldve closed the account or blocked all the transactions (I was not using this account at all after the theft, it was all the person that stole my info). To top it off they reported me to chexsystems for account abuse and possible fraud. The loss prevention dept assumed that since I got so many nsf fees credited that I must've had some sort of deal with the bank employee. Regardless of what police reports I showed to them, they refused to credit my account. It is currently in collections, and as soon as I have extra money I'm hiring a lawyer because this isn't right.
Unfortunatly, without legal help you can't win with banks very easily. You'd think they'd be on your side, and they can be very helpful at first, but if the situation progresses they lie, deny, and screw you any way they can.
My advice to you is to find a non chexsystems account, Wachovia will probably report you, if they haven't already. Even if you get an account at a bank that uses chexsystems because Wachovia hasn't reported you yet, if they do report you most banks do chexsystems sweeps and will freeze and close your account. You will have NO ACCESS to your money for whatever time period they decide on. It sucks and shouldn't happen, but does. Some banks really suck!

Yes, they can! They will refuse all checks, charge you fees for bouncing even though there is money there, and they will send you a cashier's check in 2 to 4 weeks!!! And this wasn't even a bad account. I had 4 total accounts, 1 had id theft, all accounts were frozen and later closed with NO WARNING!!! I went to the store to get groceries and found out my debit card no longer worked.

When I was going through my mess the bank manager actually told me my accounts were still open and fine when in fact they were frozen and about to be closed. I wouldn't chance it, at best I would leave a couple bucks in the account and take my money elsewhere.
It's their Loss Prevention dept that makes the decision to close the account without your knowledge. I would say there is a fairly good chance your account will be closed, so I would move your money while you still can. Who knows, the PDL's may try to hit your account again, and you will be back in the negative . . . .

Goudah, this closing of the account has been bothering me for a couple of days so I decided to call my bank and ask them if my account was going to get closed because it is in the negative (again). The rep told me that they do not close account without telling the customer. The account will be closed if it is in the negative for over 45 days. Mine will be back to positive next Friday, so I feel better now.
