I know there are a few NC members here that could probably help you better then I can, but payday loans are illegal in NC . . . . So they shouldn't have lent to you in the first place. Here are the NC laws:

I'm guessing these are internet payday loans? You need to close your bank account that these loans are coming out of, and open a new account and do not under any circumstance give them your new account numbers . . . . Then you need to send letters to each of your pdl's telling them you revoke authorization to debit your account, and that you revoke any and all wage assignments you may have signed. Some pdl's put wording into your loan documents that allow them to contact your employer and have the money taken out of your check like a garnishment. The permission to do that is what you are revoking with the wage assignment.
You need to sit down and figure out exactly how much you've paid to each company verses how much you borrowed. You may be entitled to a refund since loans are illegal in NC.
Once that is done you need to start writing letters to the companies telling them that pdl's are illegal in NC. You need to contact your attorney general's office and file complaints. In the letters to the companies you need to tell them that NC prohibits these types of loans, and you want your loan marked paid in full and if warrented, a refund of all finance fees you've paid over the amount you borrowed. There are some good form letters on Polly's blog, I don't have the link handy, but I'm sure someone else will post it.
Once you close your bank account the calls and threats will start. First off, you CANNOT be arrested for defaulting on a pdl. They will threaten anything and everything to try to get you to pay. Just stay strong. Search the threads here for the company names you are dealing with and you will get a good idea what each companies tactics are so you can be prepared.
If you want help with telling if you should request a refund, just post what you've paid, what you've borrowed, and who it's from for each loan and we can help you out.

Oh yeah, I totally agree . . . . Even if they refund your money, still get the AG's office involved. For every favorable outcome, there's probably 1000+ other people that are still being messed with. Your state's AG needs to know what's going on, expecially since they are prohibited in NC.
Be sure not to threaten reporting them to your AG. You can tell them you are, but don't make it a barganing tool. That could be considered extortion and you could get yourself in a much worse mess. Informing them is not extortion. But most of the IPDL companies are breaking many laws and need to be shut down. Your AG needs your complaints. One complaint may not do much, but if the get a bunch of compalints they will do something about it.

There is MagnumZ LLC ($250), Whistler Holding ($300), 3 Midland Market ($200), Route66 ($200), United Cash ($200), and this one whom I am not 100% sure, 6-Electronic Pay (cking statment said $200 was deposited) and it shows up twice on payday with 2 different amounts coming out. They say hind sight is 20/20 and it sure has been. Unfortunatly I had most things saved on my computer and it had crashed, so if I kept any documentation, it is gone.
As far as closing our account out, I am afraid that since out account has been going into overdrawn for a long time now, it might be hard to get another account. We have a bank that opened up called WoodForest (in Wal-Mart) that offers second chance accounts, but an not sure of them either. And yes, these were all internet loans"

I'm checking on the bank account situation for you . . . . I understand what your saying about not wanting to close your current account, but if the pdl's are just going to keep hitting it, you may be out way more money than you want to be. And since your account has been overdrawn for so long your bank may decide to close your account for you. I'd suggest not keeping all your money in the account.

I am so confused! I know we have more payments coming out Friday to all these people, so there will be a little more gone. We have all been there . . . . I had 9 pdl's out when I first came here. You only have 6 so you are by far not the worst case we've seen. It's so easy to get info payday loans, and very hard to get out of.
As far as revoking the authorization to debit your account, you just need to write a simple letter stating that you revoke authorization to debit from acct # XXXXXXXXX, routing # XXXXXXX, bank XXX, and that's it. You can keep it short and sweet.

Like I said, I had info saved on my home computer and it crashed, so lost everything and now will have to kind of start from scratch in locating all these place. I should probably state that they do not have permission to call us at work since I do not remember if there was a form in there for that too along with sending something to the AG. WOW, I feel like my head is spinning. Would be nice if I did get a refund from a couple of the places, but feel that the odds will be slim, I am sure.

I'd definatly say they can't call you at work, but most of them will probably do it anyways. Route 66 for sure will not listen to any request. They are beyond reason. They called my employer for 2 months straight, each time being told I no longer worked there. They did this 15 - 20 times a day! But they've finally left me alone. Route 66 will harrass you to no end, but they cannot do anything else to you. I don't think anyone has got them to mark a loan pif, but maybe I'm wrong. They aren't even in the US, so they couldn't sue, plus they aren't licensed anywhere.
Getting your AG involved will facilitate the refund process. It is something you need to take the time to do. But first, as soon as you can locate phone numbers for your loans, call and get them to email or fax you a copy of your loan agreement. Your ag's office can't do anything without proof a loan was given.

I know that one member that was from NC had a loan out with AIP and they marked the loan PIF without even asking because they knew that it was illegal to loan in NC . . . . . I will look around and find the name and number of the lady I talked to there and post it here. I had a loan with AIP and was getting no where. I finally got her number, she is the controller of the company, and in just a phone conversation she marked my loan PIF. There is a court opinion, I have it at work so I will post it in the morning, but it says something along the lines of "If the electronic business solicits, transacts, and continues to transact business with a consumer in another state, then the electronic business is conducting business in the state of the consumer, and is subject to the laws of the state in which the consumer resides."
All the ipdl contracts have something in them about agreeing that the loan will fall under the laws of another state. With Route 66 you agreed to be under the jurisdiction of UK laws! They can say whatever they want, but in reality they have to follow the laws of the state in which the consumer lives. If this wasn't true, then why would the legitimate PDL's bother to license themselves in each state they lend in, and why would they charge different interest rates, depending on the state they lend in?

Well, now that my mortgage check has been returned and we are already one payment behind, there is a possibility of foreclosure on our house. We do not have $2500 to get us caught up to stop this and we have only been in the house one year. I know once we can get these things pdls stopped we will have more money, but doesn't help us now. Don't know what we are going to do! :cry: We can't get any loans right now and unfortunatly we don't have any savings to fall back on, both of our parents are retired and living on just what they are getting in from retirement and we both have already borrowed off of our 401K's to try to help get by and cannot borrow any more off of them. Plus I am sitting here with a bill for my son's senior pictures that is due, need to pay the balance on his marching band or they won't give him his diploma, and all the other fun stuff for him being a senior, an electric bill that is due, and just got a call that my grandmother is in the hospital with pnemonia (she is 89) and is not doing well, so there may be an expense there. I am open to anything right about now as to what to do. My husband is going to the bank on Monday, about the payday loans and hopefully get them stopped. Have 2 letters here ready to send out to my last 2 companies, which I can't do until Monday, but have copies of the letters for the bank. I also have my paperwork printed off to file my complaints with the AG, which I plan on working on tomorrow, hopefully, but husbands friends got some people coming over, so it might be a little hard to find the time. I am sorry for getting so upset on my last post, but I have felt comfortable being able to let it out on here and not be put down for our stupidity and ignorance. Stupidity and ignorance that may cost us our home that we worked so hard to get. I some times wish I had never had my surgery and that I might have been able to hold off a little longer and then maybe we would not be in this mess that we are in and would not have to worry about where we are going to come up with the money we need to keep our home and then just thinking about what we may have to tell our kids, it is just killing me inside and it is so hard to try to keep it all in and stay up for them and not let them know how bad things really are. I know that if we can get these things (payday loans) out of our hair, we will have that money in the bank and will not be short all the time. We worked so hard to get this house and everything and in a year, it looks like it is all going to fall apart. Here I go again....I am so sorry. I am trying to get myself to quit crying and pull it together before my kids and husband get home. Please say some prayers for us that a miracle will happen somewhere/someway that we can save our home and get back on track and have a happy household and family again, and maybe it will help with the strain that is between me and my husband too.

If these are from the internet you need to file complaints with AG in your state and theirs. If your bank won't let the account close and let you open a new one, then you will need to go to a new bank to open a new account fast. And stop your direct deposit! It is the only way to get control back.

We have also talked to the bank in refernce to the loans and we have to take a copy of the letter or email we sent them in regards to revoking our authorization and sign a paper, which my husband is planning on doing on Monday providing he does not have to work, so we are in the process of doing the bank thing, but that won't help with our mortgage problem, and that is my biggest worry right now. We have already emailed those that we could fine addresses for and have 2 ready to be mailed on Monday and the forms to fill out for the complaints to the AG in the state of NC.

It's OK, we've all been there--and trust me you are among people who feel your pain. I am also the parent of a senior and can tell you from personal experience that when it comes to senior activities, most schools do grant a fee waiver for financial problems. When my husband had to medically retire from his job, it left us living on my check and my oldest daughter was a senior. I barely had enough for basic expenses.
My daughter was able to get a fee waiver for Senior Ball and Grad Night--and it was like her Vice Principal told me: It was his philosophy that no student should be denied a senior activity because of finances. Thankfully, this very special man is still at our high school. And when it comes to marching band, we were told that if students earned a grade from it (which they do in our district), then a student's diploma or participation could not be denied.
So I would call your high school on Monday and see what their policy is. You might also be able to work something out with the senior pix photographer. Does you son work an after-school job? I am with you kscornell, I have twins who are seniors and luckily the scool has a policy that senior dues are 120.00 and this includes tickets to all of the events(all the seniors get one ticket per) and any other grad expenses. But I learned years ago that the pix that are taken at the school are outrageously expensive, so I always just opt for the one year book pic it is only 20.00 (usually) and then I take the kids to Pennys or Sears for the other grad pix. In fact my twins and their friends are all going to Walmart to have them done. As to the complaints - don't wait to snail mail the letters to the ags office - email them now - they will get your complaint faster, then follow up with the letter.

When my daughter was a senior, I called up the student activities advisor and asked if they offered "scholarships" for the senior class Disneyland trip and for the Grad Night party. She said yes and all it took was me asking for it. the advisor said there was no way any other students could know who had paid for my daughter's fees.Definitely call and talk to someone at the school, maybe start with your son's counselor.
As far as the senior pictures, if I remember right, we had to pay a small fee for the year book picture and you could order small or large packages and have special sittings, etc. We went with the very basic stuff. Again, check with the activities coordinator. My daughter had a part-time job at McDonald's during her senior year and was able to pay for some of her extras.
You do what you can for your kids. If your son helps out by paying for it himself, it will be much more meaningful to him in the long run. Good luck.

I have made copies of all the letters/emails I sent out so my husband can go to the bank on Monday and let show them the letters and sign the form needed to keep them from withdrawing any more money. A couple of the companies I did request refunds from and told them I wanted my accounts marked paid in full and that I wanted a copy showing where the loan was paid in full. I will be sending Whistler Holdings Certified mail and will probably send it priority mail also, and they should have it within a day or two.
Tomorrow, probably from work, I will be getting all the paperwork ready for the Attorney General get that to them as soon as I can. If I mail it one day, they should have it the next day since I work in the same city at them. Anyway, that gets that going.
As far as my son goes, we did not order a picture packet from the people that did the year book pictures because I just could not afford them. We will be taking him probably to Wal-Mart or Sears or some place like that to get his pictures taken.

We have tried to work with the school on his band thing, but his fairshare is what I still need to pay, which I owe $200. It was $1050. (They got to a lot of competitions in state and out of state, so what I pay goes to help pay and fund these trips).
Anyway, anyone got any suggestions where I can get $2500? That is my next biggest concern is saving our house. Right now with our credit, we can't get the house refinanced. I just have knots all in my neck and shoulders and did not sleep last night. Sure could use some suggestions on what I can do? Like I said, the mortage company wants the money and has basically said that the mess we got ourselves in is our problem, which duh...we know that, but just needing some help.

Coming in a little late here, but I just want you to know that you should not beat yourself up about your decision. We have all been there. At the time we thought it was a good idea. And more likely it was the only choice available to us. Borrowing to fill the gap is a necessary option. But, when we don't qualify for other options and PDLs are the only option to take care of a need, we end up paying for it big time. I guess the answer is as someone once told me ... don't be desperate. That's a hard thing not to do since the majority of us are still living paycheck to paycheck and have no ability to put anything aside for a rainy day. Heck, whenever I had some money for a rainy day, I realized that my head was already wet from the rain. :roll:

And in re to catching up the mortgage, I know in my area, we have a group that specializes in paying off back mortgages, rent, etc. You also might want to ask if the Salvation Army does that sort of thing in your area--or if they don't, could they point you to a group that does.
It might be income-based and you'd probably have to do a loan agreement with them, but it's worth a shot. And 2nband, you can also pm from your mail box. Hit post message and type user name. This is going to get better, OK?

Also, check to see if the city you are in has a community action program. They receive funds from the government to help in dire situations. I've been helped a couple of times with 50% of rent when I was in a "forced move" situation where the landlord refused to fix problems with where I lived and created a constructive eviction situation. But, they also help with emergency funding if you are in a situation where you are in danger of becoming homeless.

Since I am at work right now, not too much I can do at this time, but hoping I will have a little time off and on today to get those complaints taken care and sent out. Didn't sleep again last night and even today my hands are shaking. Hubby did check with Salvation Army this morning, and they cannot help us for 2 reason, one, according to them, we make too much money (going off of gross of course, not what we take home), and 2 ~ the most they usually can do is $200 to $300 because of the number of people that need help. That was the response I got this morning. Keep your fingers crossed for us.

Another update ~ paperwork for PDLs in, told us to watch account to see if they try again and any more comes out and then bank will have us fill out another form and they will work on getting money back for us to help bring our account to current.
Hubby in loan dept now and they are trying to see what they can do to help us at least get the payment that was returned taken care of.
Have last letter to PDL Co, Whistler Holding, ready to go to the post office and am sending it priority/registered mail.
Will keep everyone informed as I go....now back to work.
