I was sued based on an old debt that I believe was past the statue of limitations. Unfortunately because of serious personal problems I did not reply and a judgment was made against me. The original debt was charged off and it was even earlier than the charge off date that I made last payment to the original company. A third party purchased the debt. I think that if I had responded I could have shown that the had no legal right to sue. But now I am wondering if it is too late to do anything. I recently was asked by the attorneys to provide information on assets. The only bank account I have is where my retirement check is direct deposit. I have not responded bu I was wondering if they can seize my bank account? This is my only source of income and I pay rent, utilities, food etc from it. I would have no means to live if they seized this. What can I do now?

I am sorry about the situation not going in your favor. The judgment is already served and you are legally responsible to arrange the payment. You need to check with your state laws if retirement check is used to collect on the judgment.

Make sure the collection company is authorized to collect for the judgment. They must show you the court papers before taking any money from you. You need to confirm about the company from the local county where the case is filed.
