Is the debt ligitimate or not? As much as we hate their calls, demanding them to stop calling you on a legitmate debt may force them to file a lawsuit. Since they are a creditor, not a debt collection agency, they are not bound by fdcpa ... meaning you can send them a cease and desist letter, but if they ignore it and keep calling, then you have no effective recourse to claim they violated the law.
Also, you should check NY laws on recording phone calls ... @@http://rcfp.org/taping/states/newyork.html@@. The way it is worded, sounds like you're okay recording a phone call as long as you are part of it. To be safe, you should let Capitol One reps know they are being recorded so they can't come back at you later.

cant settle or deal w/the debt collectors or them sewer service law suit and they posted sherriff sale notices all over the front of my home for a 2000.00 bill they have up to 12500.00 w/ law fees and 20% intreset when iv been undergoing cancer treatments.......horrible company w/hilter antics and nasty debt collectors that call all my relatives and had my grandmother in tears screaming at her
