Incarceration, would that be like an order to have one put in jail or something like that? When a person is incarcerated, they are in jail, right? Not trying to make you scared or anything like that, but I believe that is what it means. If you have filed bankruptcy, you should give people your attorney's number and have them call him to verify that you have filed.

Incarceration? That is jail time. Since when is there a debtors jail? Obviously if you have filed bankruptcy, they should have received a letter from your attorney stating this. Also, since when does a collection agency send a letter by email? Is this a new method?
Well..i told them
that we were filing bankruptcy adnw e dont have all the info they need yet! But I can't believe I actually have something in writing from them telling me there going to put me in jail.

After I typed my message, I thought about creditors sending things via email, I don't know of any that do that either. They will either hound you on the phone and constantly send you letters via the USPS. We had filed a couple of years ago and had to pay our attorney most of the fee before he filed and had to have him PIF before we went to court and it took us several months to get him paid, but he still let our creditors know that we were filing. Hang onto that email!

Capital will continue their collection activities and perhaps take legal actions until the debt is discharged in the bankruptcy. You have to speak with your attorney and speed up the filing process.
Just asking, has Capital collections validated your account and prove their authorization to collect on this debt?
I have nothing
from them regarding who they are even collecting for. I have a few outstanding payday loans..i am just waiting on the funds to come up with to file this bankruptcy.

KSpenneberg, It is a violation of the Fair Debt Collection Practices Act to say that they will put you in jail. Do a little research and you will see that they can be fined up to $1,000 for violating the act. I would not pay them a penny since you are planning on filing for bankruptcy. Before I filed, I told all of my creditors I would be filing soon and gave them the number to my attorney. Even if you don't file soon, once you file for bankruptcy any liens and/or judgments they can get against you will go away once you file. Also, do not let me harass or trap you into paying the debt. They will try everything they can do in order to get paid before you file. Hang in there and everything will be okay.

This is a commont tactic if is it a collection agency for a payday lender. I would contact the Federal Trade Commission to file a complaint against them along with your State's Attorney General's Office. This is a violdation of the FDCPA because they cannot threaten you with arrest as it has been stated in previous posts. If you don't have an attorney now, I would show this e-mail to them once you retain one for your bankruptcy process. You may also want to find out what state Capital is located in and file a complaint with their Attorney General as well. I can't believe they were dumb enough to send an e-mail like that.
