What is SOL and can a creditor sue the debtor

Hi, I have a question...What is an SOL? and I just received a lawsuit letter from a creditor's lawyer. It is a summon to court. As for a I know, my debt is over 2 years old. Can they still sue me?


Sol= statute of limitations. In the credit world,there are two different ones everyone deals with.The first is for legal action to be taken(court action).This is controlled by your state statute where you live. The next is for reporting purposes on your credit report.It is governed by federal law and is 7 years from date of first delinquency. With your debt being two years old,I would say yes they could definately sue.

Send the lawyer this letter.

This is a debt validation letter. It will ask him to prove that this is legally your debt and that he can legally collect on it.Send it certified return receipt.

Hi all, thanks for the info. I went to check the SOL for my state, CA. Its 4 years for written and 2 for oral contracts. From my CR, the original creditor DLA for the accounts were 3/01 and 9/02, but the date reported were 7/04. Which dates should i look at for the SOL. With these dates, am I still be sue at?
