I have a question regarding disputes with collection companies, specifially Palisades. I have been disputing my "account" for about 2 1/2 years. Its seems i lost the dispute becuase Palisades either cant or wont to anymore research into my situation. i cosigned for a cellphone(bad idea ..i know) about 5 years ago, and this person had a 450$ bill. She got married, and transferred the debt to her husbands att account. before she could transfer and close the cosighed account, she needed(per att policy) pay the 450$ off. For some reason this was done on the husbands account, not the cosigned account. Well ATT did not update the cosigned account, and so it shows the 450$ as still unpaid. I have bank statements showing this amount being paid, but since ATT doesnt show that, Palisades wont be reasonable. I tried to get copies from ATT for the husbands statements back then , but ATT will not help me. Palisades says since that account is not theres, they dont care, and will i pay with check or money order(hehe). Now that i lost this "dispute" with them, is that the same as losing a dispute with the credit bureus? Palisades says the next step is a "refusal to pay", and ive had this open collection on my account, "disputed", for 3 years, now from my understanding i wil have a "refusal to pay" for 7 years? Can i re-dispute this? I hope someone has an idea, since im being screwed by the big guy.....

thanks so much

aaron

Ok,
Lets get this started:
1. Read this and understand it.
http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm#809

2. Send this letter to them certified return receipt.

3. Before you make a payment on this debt, find out your statute of limitations for this debt.It may be old enough that it would be out of sol.

Check back in after you have gotten results from this letter.

Aaron, try to dispute the item with the credit bureau and make them investigate with the data furnishers. Show them proof of your bank statements explaining that you have already paid the account to ATT but they are not willing to update the file. Palisades is doing collections because they don't see it paid with ATT. Highlight all the points in your dispute letter and let the bureau investigate it. They will give you the results of their investigation within 30 days.
