problem with a payday loan company

Help -

I just had two debits taken out of my account from Ambassador Collections aka Nationwide cash. The man there said I had taken out a payday loan in february 2006 and then defaulted. I did not. My ex-boyfriend may have (i lived in a very abusive relationship that I have since escaped from and have tried to start a brand new life). They attached a different bank account (different bank) and told me the6y have every right to do so. I told them to prove I took this loan out (show me my signature) but he said that it was done electronically and couldn't but that I was responsible for this loan.

Talk about sending me back into the hell that I escaped from. He wanted proof that my ex-boyfriend did this. I was too intimidated by me ex to file charges with the bank and the cops told me to just stay away from him (they did nothing).

I am in Florida - the payday loan company said they will continue to follow my bank account history and will debit again (it's my mother's account but my name is on it to write checks).

What can I do? Please help me?


I would dispute the charge with your bank. The company will have to prove to the bank that you gave them authorization. Do a search for nationwide on this site, and you will find a lot of info on them. Print out some of the posts and take that with you to the bank. Tell them that this company won't stop trying to debit your account, and ask the to block ALL ach transactions. Just blocking the company won't be enough because they will just hit your account under another name.

You may also want to consider closing the account and opening a new one at another bank.

Question - I think it says in your post that the account they debited isn't the same account that they deposited the money into. Is this correct?

Also, you may need to file a police report.

Especially file that police report, even if they do nothing,this will make you feel not as vulnerable and are able to do something. I echo disputing the charge with the bank---they will have to research it and can get to the bottom of it. And again close your account---if only for peace of mind.

Have you sought counseling regarding your abusive situation?

I have disputed the charges and the bank has refunded them and I did open a new account through this same bank (Bank of America). The one that the money was supposedly put into was a Washington Mutual account - which I left behind when I left my ex boyfriend (it was negative because of him). I never authorized them to debit this bank account. they say it doesn't matter.

Can I file a police report this late for something that happened last year?

The person I spoke with at the bank told me there was nothing I could do - that they (the loan company) could follow me (she didn't seem too knowledgeable though.)

When I talked to the company her got me all confused and upset and I refuse to talk to them again and I refuse to pay them the money.
