my wages are getting garnished and im being sued for medical bills i don't own my home and i have a 94 car so i don't have anything for a loan please help kim


Hi Kim

Who is the company taking you to the court? Is it the collection agency or the doctor's place that issued the medical bills?

Give a call to the original creditor and get some arrangements done on your debts. You have to send some money in good faith. This is the only way by which you can save yourself from going to the court.

If your wages are already being garnished then the case has already gone to court and a judgement has been entered against you.

Most states have limits on the amount of your check that can be taken in garnishments. So even if another company is suing you and wins a judgement, they probably won't get any money until the first garnishment runs out.

You should answer the summons within the time limit it gives, or else a default judgement will be entered against you. It is much harder to fight after that.

Hi..

You do have some options. First of all, the most you can be garnished for a consumer debt..And med bills are a consumer debt..Is 25% of your disposable wages..Which includes taxes, insurance, and any other voluntary deductions. Garnishments are federally mandated, so unless you are in Texas, the carolinas or Pa( garnishments are illegal in these states) you WILL be garnished 25%, period.

You can contact the original creditor. I file garnishments for a living, and I have seen creditors willing to stop the garnishment and accept payments. You would have to pay additional fees, though..Filing costs, attorney fees, etc. I tell employees that in my opinion I would go with the garnishment..The payments in a garn are less than they would accept, and it's already on your credit report, so there is no point in thrying to stop it. If you can't afford the 25% and can prove it, you can go to your county courthouse and file a tort. This says you are unable to pay and need it reduced. Have check stubbs, a budget, and w2s with you.
