Question: What is the worse case scenario?
Date: Thu, 04/05/2007 - 05:25
I refuse to pay one more cent to several of these companies --
I am changing my phone number even.
I just want to know what is the worse that can happen.
Thanks,
Sarah :)

The PDLs usually report their chargeoffs to Teletrack, but not to the major bureaus. Since PDLs are about the only people that use teletrack, this might only prevent you from getting more PDLs in the future.
However, if the PDL sends it to a collection agency, the CA might report it on your credit file as a collection item.
Other than that, the legal issues also depend on their legality. If it is an online PDL, they would generally need to be licensed in your state if they wanted to sue you. Even at that rare chance they are licensed, chances are that they won't send their attorney on a cross-country mission to come sue you.
BUT if it is a storefront PDL, then you do run the risk of being sued.
The absolute worst that can happen, is that a legal PDL takes you to court and gets a judgment. After that, you either pay the judgment amount or they might try to get a court-ordered wage garnishment sent to your job.

Okay, great information. I owe two places that are in my state -- licensed, that is -- and these two places I am paying off. So they are not the problem.
As for being able to get more PDLs -- NO THANK YOU! :) So being in teletrak won't be THAT bad. Does this company affect me being able to write checks at stores?
As for the other companies, they are illegal to begin with, and so I am not worried about being sued. I am going to try and get them paid off one at a time just to avoid any legalities, etc.
But again, THANK YOU for your honest opinion!

telecheck is the company that processes checks at a store ... it is completely different than Teletrack. You should have no problems writing checks.
I'm glad you're getting these under control, one by one. The online PDls will threaten you, and tell you that you're committing fraud, and that they will come arrest you. If you change your number, that can help. But make sure your next number isn't listed. If they know where you work, they will bug you there too and try to embarass you into paying. Just don't let them get to you.

I work from home and so my home is my work. The only phone number I gave them was the Univerisity's number that I work for home for. That main line will get them nowhere as I am low on the list of people and do not have a direct line from that main number. I am changing my home number though -- soon. Lay low until my *real* bills are paid off and then work on them.
All my loans are small $200 or $300 -- the largest one was settled. So I feel so much better than I did a couple of weeks ago.
Again, thank you SO MUCH for your comforting words.

One last thing-- they will claim that you "electronically" signed a wage assignment, that gives them permission to garnish your pay without going to court. They will probably call the university and threaten payroll to take $$ from your check. Sometimes an uneducated payroll person will give in because they think they have to.
To be safe, you should sent a letter to your payroll dept saying that you revoke any voluntary wage assignment that you previously signed with XXX Company. Good luck.

Excellent advice from DebtCruncher and I can add that if they try and give you the line from the book that you have written a bad check, blah blah, if it's an IPDL, you can come back with the fact that you haven't and then challenge them to produce the check that was supposedly "returned".

I think the worst case scenario is going to be that they are going to forever harass you, call your work, your references, etc. If you revoke your voluntary wage assignment and they are IPDL's that are operating illegally, there is not much they can do beyond that. They will tell you you are going to jail, all kinds of threats, none of which are true.
