Garnished paycheck and bank account

Hi

Today i was told by my bank that an attorney's office took all of my money from my business account and garnished my wife's paycheck.

I am a signer on the business account and still yet they took the money from my business account. Please note, i didn't receive any letter or letters from the attorney's office they just went ahead and took the money from my account also wife's paycheck.

Please help ... what can i do? I need your help... thanks...


my husband is a cosigner on his sons student loan, parent plus is what its called, the collection agency is stating they will garnish both my husbands wages and his sons wages and they dont need a court order, however we also have not received any paper work that this collection agency has this debt and that they can garnish both wages but are rude on the phone and threatens us with this garnishment what is our rights

Yea...............I think in ANY state you live in, if you have any kind of Ferderal thing (school loan, taxes due, etc.) they can garnish your paychecks. Even Child Support, I think. I just thank goodness, I live in a state where NO ONE can garnish my paycheck for anything...except Federal things. SOME states, I know, CA's can garnish paychecks.

This should have been posted in the student loan forum but I will answer it here.

Parent Plus Loans are not cosigned loans....it is a loan taken out by the parents for the student. The student has no legal liability whatsoever to pay this debt....only the parent.

Your husband can be garnished without taking him to court....it is called administrative wage garnishent. They can also seize his SSI and any SSD when you reach retirement age plus state and federal tax returns and stimulus checks.

i have a default judgement against me, can this affect my student loans. i am in school now, but i want to know if this could affect my status of obtaining student loans.

so creditors can take money from your payroll now, without even going to court. What rights do we have? and is banckruptcy the only alternative?
