I signed a Voluntary Wage Assignment which was notarized, I cant make the payment that the payday loan company is requesting. They said they tried to debit my account and now are charging me an nsf fee of 25.00, but the funds were in my account! They want me to western union them 85.00 today which i dont have 85.00. The declaration of Wage ASsignment states "I acknowledge this instrument as an absolute, unconditonal, and revocable assignment and sale of the said amount of my wages" What does this mean. They will garnish my check for over 2000.00 according to them for a 200.00 loan! Help!!!


Immediately send this company a letter stating that you revoke the voluntary wage assignment. Contact your payroll dept and tell them the same thing and follow up with a letter to them as wekk. What company is it that you are dealing with and what state are you in? How much have you paid them so far?

I agree, send a letter revoking it and do make your payroll department aware of what these people may try to do. Provide them with a copy of the letter that you sent out so they know that you did revoke it. Also watch your account. They may try to pull everything right out of your bank account also. Stay on your toes! Please state what state you are in? That will help a little bit more.

I have faxed over a letter to my payroll revoking the Voluntary Wage Assignment per the Federal Trade Commssion Credit Practices, I also sent a letter to the 200cash.com revoking the wage assignment and said i would be filing a complaint with the Federal Trade Commission for them not disclosing a truth in lending document for fees and apr.

Nothing. My first payment was scheduled for last friday, i had the money in the account. Yesterday I recieved an email saying that it came back NSF! I know this isnt true. Now they are racking up fees on me. They say I now owe 320.00 right away or 85.00 by western union. Why should I have to pay 25.00 NSF when I know the money was in my account?

I am on the phone right now with my bank. They are stating that 200cash.com tried to pull the funds at 9am April the 13th. The funds were there according to my bank.

My bank has just stated that they can not debit my account using the aba and account numbers. they would need to actually run my debit card through. My bank has also stated that 200cash.com tried to debit my account on March 22nd for 19.00 and they couldnt, so if they couldnt debit my account why would they still lend me the 200.00??

They definately sound very fishy. I am also in California and know for a fact that the only way you can be garnished (except for taxes and child support) is through the courts. Revoke this wage garnishment IMMEDIATELY if you haven't already done so.
I had also signed a voluntary garnishment when I was loaning with Sonic and they did try and collect on it--but my employer sent it back and didn't want to do it! Sonic was forced into taking my payments, which they didn't want to do, but too bad for them!
