I am so scared. I am in TN and I am going through the same thing paying off this loan. I had two loans with them. I paid one off, I paid approx $500 more than what I owed to get that paid off. And the other loan, I have already paid extention fees, plus $250, and they say I owe another $590, and it is adding up daily. HELP. I told her the TN law, that I had contacted the Attorney Generals office, her response:
#1 we are not governed by state laws. #2 the extension fees paid are just that EXTENSION fees, they do not apply to the principal.
I requested my documents, and she said:
I will try to take time to find the signature but that is the only "documentation" there is. There is no documentation previously than what
was deposited to your bank on the fund date. EXTENSION fees do not count as payments. I am willing to settle the difference but it will not be less than the principal loan amount on the account. By prolonging this you only cost yourself more in the end.
WHAT CAN I DO? I HAVE TWO KIDS AND NO MONEY LEFT, I AM SO SCARED.

It looks like Westbury is violating the laws in your state. They are lying by saying that they don't have to follow the laws in your state. Besides, roll overs are not permitted in your state. So, they cannot charge you a fee by extending the loan. Contact your state attorney general because it seems that you have already paid them their principal amount.

I filed a complaint with the BBB and my state's attorney general, within one week they contacted me and marked my account as paid in full (PIF).
They are real pains in the asses to deal with. But hold your ground. They know they are doing things illegal and will through a lot of mumbo jumbo around at you -- and they will be really rude and threaten you that you are "going to be sorry" and "you better get a better job because you are going to pay."
So, keep emailing them, and tell them the laws as per your state -- hold your ground!!

Send them a copy of the laws of your state, highlighting the ones they are violating. And they're lying when they say they are not bound by the laws of your state. Do they still have access to your bank account? If you haven't already, I would close the account and open a new one to get control of your money. They have many names they go by. If they can't get to your bank account using one name, they'll try several more times with one of the many other names they go by. Good luck.
