Hi,

I submitted a question here yesterday and it was helpful about payday loans nightmare, but i am drowing more quick than i thought. I cant even pay rent, car payment, grocreies, all bills are due now. I had a chaprter 7 discharge 12/2003 and thought my life would be great after, and now i find myself even deeper and scared and alone.

my question is can i file a chapter 13 today, has there been enough time since my chapter 7? if i cant do this, then if i can i will of over the limit at the atm with my credit cards, pay off some of the payday loans, and rent,etc. and then crawl under the nearest rock. i need help and advise so bad, please help me

I'm not sure if you can, but I think it is possible to file a 13 four years after a 7 . . . But it is not advisable at all to go over your limit intentionally. The new BK laws made it so that any debt incurred within 90 days of filing give the creditor the right to object to your BK. So if the credit card that you used to pay off the payday loans decides to show up in court, your whole BK could be thrown out, and you wouldn't be able to file for a certain amount of time.

James-to answer the question you left on my quick message-I think that you can still file chapter 13 bankruptcy on check n go even though they have those 8 post dated checks but you need to close that bank account and open a new one because they will most likely try to cash them anyway. You would need to notify Check n Go not to cash them anymore because you are filing bankruptcy but I don't know if they would give the checks back to you or not.
