Arrest for defaulted payday loans??

Can you be arrested for a defaulted payday loan?


I am trying to make arrangements with Ace cash service.. i made arrangements to pay but due to a scam i had to cancel my debit card and get a new one.. with the scam i got cleaned out.. so i told ace i had to hold off for a bit and they told me that i could not and i should pay with a prepaid visa... i wish not to because i have no record then... what can they do if i hold off on paying them?

well a couple of questions.

1)how much was borrowed.
2)how much was debited before default.

ace cash services is not a legal lender therefore you are only obligated to pay the principle borrowed.anything debited they call fees gets deducted.btw they can do nothing but call and threaten.as far as the prepaid visa goes some people advise it i don't.not for an illegal lender.try to answer the two questions i posed as you might be suprised by how little you do owe.

They put 300 in my account meaning ace cash .. which i did not sign papers for or an electronic signature when i called to have them take it out they said no i was locked so i took the loan. they took out a couple payments of 75.00. I am assuming they will call on friday when they go to take money out and my card is no good due to the "indian scam" i was involved in. These people were very rude and said court action would be taken.. and i was nice enough to call to see if this loan was paid because i gave money to the "scam" thinking this loan did get paid and now they refuse to listen to me.. Any info on QXL ONLINE? are they legal?

can anyone tell me if QXL ONLINE is a legal online payday loan company? I took a loan with them and they have been taking out 76 dollars every 2 weeks. They have no number to call to make arrangements to pay back with installments just the customer service on computer which they only say pay all .. no payments allowed.. I live in NH and i want to stop payments before my account goes negative... please help-

I've been getting harrassing phone calls telling me that I am going to be arrested and that they will have the local authorities pick me and that I will lose my job. I've actually paid this caller some money on a prepaid, but when I went to make my final payment today I attempted to call them to let them know the money was there and the number had been disconnected. So, I attempted to call a second number I had for them and it directed me to a new international number. Of course, I became very suspicious and decided to google the numbers only to find out that the numbers are being reported as scams. So, needless to say, I ran up to the corner store and withdrew my deposit for them to take and figured they are just gonna have to come ad get me. I live in Texas and just wonder could I ever even be arrested for defaulting on a payday loan? These are really scary calls and now they have all my personal information and I am worried for my families well being. Any suggestions? The number they are calling me from is 305-590-8811. The people calling speak with a foreign accent and have names like Austin Jones or Phillip Davis and they claim to be with American Law Division.

I had a payday loan with advance america and it is in default. People call me stating that they have a summons for me. I know that I live in Texas and I know the area codes in texas is not 310, but it be different numbers and different people calling me for the same thing and same company. Can they do something if they do not serve mr the summons. Write know they are trying to get me to respindbecause they have my old address and i have mived toanother city> I dont mind paying them back but not know

I have about 3 online payday loans. I were paying them good but my hours were cut due to low patients count. Everyday a maqn calls my cell phone aqnd my work plaqce threaten me. He said that he is going to downlaod the information to my state and have a warrent for my arrest. I have tried to make arrangement with him but he just laughs. He said that I have to pay like $4300 back. ! live in Mississippi. I'm so scared.

well the "downloaded"threat is just that a threat.btw they can't have you arrested and sue you.here is what you do.

1)file a police report as the threat is illegal
2)use whatever name he gave or phone number to file AG AND FTC complaints against this idiot then.
3)ignore him,or hang up on him as again a bottomfeeder that needs to illegaly threaten because they have nothing else.

do that and relax.he cannot do anything he threatens.

I was called today by a lender stating he would have someone from his office come here to the office of where I work and have the officers take me to the court to appear. There was no case number and he stated that I would be going to jail because this is a criminal matter. And that I had not paid on this loan a couple of months and that he was the chief investigator and that he was sending his people to collect me to take me to court. And the more I arruged with him the more he got frustrated with me. I he did not speak very good english and that he was going to take me to court. And then when I researched the attorney office that he stated that he was through did not exist.

I have been on this site for hours looking at all the post and I must say that i am in the same postion the only thing is i did not recieve a pdl I went back into my transaction history to verify that i didnot recieve a pdl which i recieved a call about. however i live in ny and i don't know what to do about this because i am being told that i will be arrested first thing in the morning for criminal charges and the fbi will be involved because 1 of the charges is fraud on my part. this really startled me and my children and they are in fear that i will be arrested and they will lose their mother. i just want to know if this will happen? will i be arrested?

I received a call this morning from someone stating they were trying to collect on a PDL from Nov 2005 - it is now March 2011. Honestly, this is the first time I have heard about this one and thought everything had been taken care of.... Whe I stated it had been almost 6 years she asked me if I had any intention of taking care of this in which I replied - not until I know it is valid. She then said she was turning it over to the county I lived in and hung up? Not sure what she meant by that... Anyway, I called back about 40 minutes later and asked for something in writing and she said "lady, I didn't like your attitude" and hung up again. I did a reverse look up for the number and it doesn't appear to be a company at all - just listed an indivduals name.

I question the validity of this claim as it has been almost 6 years with no other calls? Wouldn't I have heard something by now? Can they do anything about this?

Advance America can NOT take you to court for not paying them back. Them treating you alone could get them fired, as that is against their policy. They may have sold your check to an outside company that is just trying to scare you. Next time they call get all there information, name, location they work, there work number. Then call the Advance America comment line and complain about them treating you.

I am in a bit of a tight spot with an online lenders myself. They are called Magnum Cash Advance and Cash Jar. I am not in default with them yet but am do to pay 750.00 by Friday for MCA and 150 for CJ. and then the same amount in June. (I cannot do so!!!). I live in Virginia. I'm really worried at what would happen if I put a stop payment on these accounts.

I thought I would let you all know that I decided to take the bull by the horns (so to speak) and called Magnum Cash. They accepted a 100.00 pay tomorrow and then split the rest in 5 months and cancelled all interests. The lady I spoke to was very sweet and understanding. She told me to call back if I needed any more assistance.

Everyone, I got in contact with a lawyer about these same exact stories..she said she couldn't do anything about it since the companies are not legitimate, but she did give me this useful link which will provide all of those who are receiving these calls about being arrested:

I just got off the phone with a so called "investigator" who said if I don't pay a loan back which came from cashnetusa. They say they are in Orange County, Texas but he could not provide me with the name of city nor provide me with an actual internet website. So I'm calling the bluff. Is it true they cannot arrest me?

Not the online payday lenders...BUT in south carolina the in store payday loans are getting warrants for people arrest even though its a debt.I called the county magistrate today and they said YES!!!! A payday lender from a store(not online) can put a warrant for your arrest if your check do not go though the bank!!!!The lady said south carolina has change the law even though its a loan.She told me they used to not go after people for payday loans but now the payday law in south carolina has changed.So now the "stores" can get warrants for a nonpayment.The debter prison are back in SC...sad...What next credit cards??

i really dont recall making a loan with this company and its nowhere in on my bank draft for the time they said i took out the loan . They called myjob today and said they were coming to arrest me they sai i owe them 395 but when they come out if i dont have 1500 dollars cash they are taking me to jail can a loan company do that?

no pdl can have you arrested.especially an online pdl.file a police report for the call.then use any info.ph#,name to file AG,AND FTC complaints.just know anyplace no matter if it's a pdl,or bottomfeeder calling to try and collect.threatening arrest is illegal.period.

if you have a pay day loan and someone is calling you saying you will go to jail if you dont pay asap, REPORT IT! they are NOT with any payday loans. search their name on the internet so when you report it ot the police, they can have more information. some company tried this iwth me, after i had paid off the loan in full. i called my loan company and they c onfirmed i did pay, just in case i forgot to pay i called them.

Listen dint sit here complaining about "scumbag" collectors when all they're doing is trying to collect the money YOU borrowed. Call them and make payments, don't try to run all you're going to do is make it worst and possibly make your credit worst than it already is.

If the loan is illegal then any collection agency trying to collect on the loan are acting illegally. By federal and state laws you are not legally responsible to pay ANYTHING back on illegal loans as they are not enforceable and not collectible.

The borrower is only MORALY responsible to pay back the actual amount that the lender deposited in their account only if the lender does not sell the debt to a collection agency. The agencies and lenders know that the loans are illegal and thus when the loan is sold there is no longer a moral responsibility as the law was broken twice. Once for the illegal loan and then again for the selling of the illegal loan.

I live in NYC. Ive used One Click Cash a few times for payday loans. The first two times were pretty straight forward. This last time took me for a loop. I paid and paid and paid and finally the last payment turned into triple the amount of the loan. I blocked the company from withdrawing monies out of my account. Now Im being threatened with arrest. When I speak to the so called attorney's office Gibson and Gibson they are rude, abrupt and dismissive. I only asked that they send me something in writing if I indeed owe them a balance. This has been a crazy and uncomfortable feeling over the past two weeks. I cant sleep because I keep thinking I am going to receive a knock on the door and be dragged out in handcuffs. What is my recourse?

I live in Texas and I got a call today saying I will be arrested
tomorrow when I get to my job. they had the last 4 digits of my social and my job's name and address. they say it is because
of defauting on my payday loan. they are even calling my boss.
can they do that?

Last year I used a savings account to take out 2 payday loans. I lost my job soon afterwards and now I'm getting calls saying I'm about to be served a summons and they are going to charge me with malicious intent to defraud a financial institution and writing a bad check because I have not made any payments on the loan. They said it could result in jail time. I live in New Jersey. What should I do?

I would call the Sheriff's office in Round Rock and ask and then ask to press charges... Pretty sure a scam...but you need to notify the authorities that some one is impersonating the police and give their number off your phone.

I was contacted by a woman couldn't understand her, she said that she was from the sheriff office in round rock, Texas and said I committed a fraud from not paying on my payday loan and they were waiting for an application for a warrant .

I keep getting calls from (415) 484-6151
San Francisco/North Bay Area. He's telling me that if I don't pay them money I will be arrested. He keeps telling me to put the money on a geeendot card and give him the number. Since the first call, I haven't answered or returned his calls. I'm pretty sure it's a scam. He seems to be the voice on the other end of the phone for many different numbers.
