You can go to court and request that this be reduced. My sister did that and they reduced her garnishment from the max 25% down to 15% as she is head of household.

Just make sure that you have copies of all of your expenses when you appear in court to document your claim and hopefully the judge will lower the garnishment percentage.

I read that the statue of limitation was 4 years to take legal action in court. After a divorce I thought this debt was paid by my ex husband and now I had this person call and say she needed my statement over the phone before she has the judge sign the order to attach my wages. I am a single mom with 2 kids and an elderly mother living with me. If this happens I will sink and need to know how to file a hardship. I have never even received anything in the mail, just a phone call at work.

I was making monthly payments but got laid off for 3 weeks.I got behind with everything.wrote a letter to the company to inform them of my hardships.I didn't get a response I got a court ordered letter stating garnishment of my wages had already begun. There is now a offset on my federal tax return. They've already been getting the state taxes for a few years. Can I file for a hardship claim I really need it
