PDL Help in California Please

Ok, I have been previewing this site for a couple of months now and have implemented many of the suggestions. Now I need some more specific help related to my PDL loans. I enrolled with PDL Assistance about a month ago; however, I realized I may still pay too much back on them in their program when you include their fees. I have already closed my checking account and have opened a new account at another bank. My PDL's are all internet and looking at previous post all but one is registered in California. Here is the list:

Payday Max Loan: $750 Paid $536
Discount Advance, Loan: $750 Paid $804
Metro (Geneva Roth), Loan: $400 Paid: $720
Paychecktoday, Loan:$400 Paid:$480
Cash Advance Network: Loan $400 Paid:$480
Little Loan Shoppe, Loan:$300 Paid:$270
United Cash Loans: $300 Paid:$270
Payday One, Loan:$300

The amount paid are through the lovely fees they charged every two weeks until I stopped the madness. The PDL assistance program, including settlement and their fees come out to an estimated $3300. However, from previous posts it looks as if I have more than met my responsibility to most of them. Is this correct? If I were to do this on my own can someone specifically outline the steps? How do I find the addresses for these? Am I throwing money away through the PDL program? Thank you again for your help?


Hello eladril3 and welcome to the community! :) I am moving this to the pdl section so it will receive more attention. One suggestion, you can place the name of the company you wish to gather information on in the search box in the upper right hand corner of this forum. A list of topics posted by other members of this forum will come up who have dealt with these companies. :)

On the ones above that I paid too much, do I send a letter requesting a refund of that amount? Do I send a verification of debt letter first and then a letter stating the state law, then request a refund?
So far the only one that looks legal from the California Department of Corporations is Payday One.

Actually, you could ask for a 'verification' of the debt, but they will most likely only respond that you look over your contract. If I were you, I would file complaints with your AG, and the FTC, then notify these companies of what you have done [file complaints], that always gives you a little ammunition to toss at them, in that letter I would include that they should cease & desist contact with you, revoke ACH transaction and most importantly, revoke any and all wage assignments you may or may not have signed with them, and promptly give a copy of the wage assignment revocation to your employers payroll department. In your complaints, state the resolution you are seeking is a refund of the over paid amount, and make sure you make it clear these companies are lending money illegally & are unlicensed to do so. That's kinda my advice. Hope it helps. :)
Oh and, why not demand a refund from these companies, all they can say is no!

This is a letter that I came accross. Will this help with my PDL situation?

I received a call (or letter) stating that I owe your company $ on the above account. Please be advised that this is the first communication that I have had with your company regarding this matter by phone, mail or otherwise.

Please be advised that pursuant to the Fair Debt Collections Act, 15 USC1692G Section 809 that this debt is disputed and validation of this claim is required. To validate this claim I require the following:

??????? What the original debt is for
??????? The amount of the original debt.
??????? How you arrived at the amount you say I owe
??????? The interest charges applied to the original debt.
??????? All payments received regarding this debt with the original creditor including the date and amount of each payment., (This requirement was established by the case Fields vs. Wilber Law firm, Donald L. Wilber and Kenneth Wilber USCA-02C-0072, 7th Circuit Court, Sept.2004)
??????? Any penalties associated with the original debt and the reason or reasons for those charges.
??????? Proof that any interest charged does not exceed that allowed by law in the State of California.
??????? Provide me with any papers that say I agreed to pay what you say I owe.

??????? Proof that you are licensed to collect in the State of California
??????? Proof that your client is licensed to operate a payday loan business in the State of California

Furthermore at this time I am advising you that I am not to be contacted by your firm or any of its affiliates, subsidiaries or clients by any other means other than the United States Postal Service. Also you are not permitted to contact my employer, friends, acquaintances or family regarding this matter. Also any agreement of ACH withdrawals from my account and any agreement of wage assignment are hereby revoked.
If your office can and does provide all the information that I have requested I will require a minimum of thirty days from the receipt of that information to investigate its validity and to retain counsel if necessary. During this thirty day period all forms of collection must cease. Furthermore if your offices fail to respond to this validation request within thirty days from the date of your receipt all references to this account must be deleted from my credit file and a copy of such deletion request be forwarded to me immediately.
