I am dealing ith them right now and it has not been pleasant to say the least!!

Welcome to the Community :D Isn't David Greico someone from the Godfather movie?! Yes, they should have sent you something, within 5 days, I think, after the first phone call.

I would discuss this with your bankruptcy attorney, and then when you file and they call, refer them to your attorney. somone will come along and corret me on this if I am mistaken.

Called these nasty people back.

I asked for an address to send the Debt Validation letter.

They claimed they don't have to follow that because:

#1 They informed me of the debt
#2 They spoke with me on (gave dates) such and such. Unfortunately I can prove that on the 2 dates I was hospitalized.
#3 I made arrangements already and that my bank account number was off one digit (hence the reason for the call, for me to give him the correct account number)
#4 case Fields v. Wilber Law Firm was invalidated 2 weeks ago.

When I told him I still needed the address he said "just give me your bank account number and get over it".

When I told him I was recording the call, he hung up.

HA! like you are just gonna fork over your bank account number. tell him to eat dirt. Frankly they got more nasty with you because of the bk thing. Did you file 13 or 7? if you are filing 7 they will get nothing and know it. Im glad you are documenting these calls. I made this mistake and now i tell everyone to have a little notepad by the phone, dates times, names what they said etc. the fact that you were hospitalized and they are lying about the dates have it all handy. Talk to your bk attorney and see if there is something that can be done. Frankly they are harrassing you illegally. Which is normal practice but let them know next time you are aware of it.

I received a threatening call from these people too almost verbatium to what is above. These people have got to be stopped and I will be looking into filing a lawsuit against them for threatening me via phone voice mail.

Has anyone noticed all of these names are from movies for these people. The name left on my voicemail was John Triton which was a character played by John Cena. I got the same threatening vm that once his decision was made it couldn't be changed and I needed to call him regarding this legal matter.

THEY HAVE BEEN CALLING ME AT WORK ALMOST EVERYDAY. I HAVE MADE PAYMENTS ON THIS ACCOUNT WITH THEM. WHEN I COULDN'T MAKE THEY SCHEDULED PAYMENT OF $350.00, NICOLE WILLIAMS STATED THAT SHE WAS THE ONLY PERSON HANDLING THIS ACCOUNT AND I COULDN'T SPEAK TO ANYONE ELSE ABOUT THIS MATTER. I'M SCARED AND I DON'T KNOW WHAT TO DO. I WANT TO MAKE PAYMENT ARRANGEMENTS BUT THEY WON'T LET ME . THEY WANT ME TO PAY THE WHOLE AMOUNT AT ONCE.

It needs to be an agency/law firm in my own state, they must notify me in writing that they will sue in 30 days if I do not respond. Am I correct in assuming that? He also says he is with a collection "firm" not an "agency". Is there a difference? He is trying to collect $735. Well I believe the original loan was $300 with a maximum fee of $90. So I have no intentions of paying a dime more than that. He said he will try to settle for 50% of the $735.

I also want to state that I have worked with plenty of debt collection agencies in the past, many of whom people say are "scum". I find that if you are polite they also will be. I have been able to work out arrangements and paid of several debts. I am not the type of person to skip out on what I owe. I just fell behind the past few years due to $35,000 in credit debt which has been paid off for over a year now! So I am trying to clean up all the little "leftover" stuff.

And one more thing.....when he spoke to me yesterday he said VC Funding was part of CitiFinancial. I have NEVER had a loan or done any business with CitiFinancial, who is obviously a major, reputable company. He mentioned this so called pending lawsuit would be for defrauding and breach of legal contract and that it was a National UCC Filing.

I was a little leery at first.; but i dont have anything to gripe about frank shapiro. It was a legitimate loan , i needed right after my divorce. He explained to me that he would help me and he did. I resolved the account, and got my credit cleared as well. But he was very detailed, and explained the process to me of what really happens. And i took all of his notes to my family lawyer. And he said that mr shapiro was exactly right and stated that he wanted his number, jokingly about a job with him.

SRS & Associates is a mediation and litigation firm. If you make an agreement with them, ensure that you receive it in writing. Also, if you want piece of mind, ask for a validation of debt letter as to who you have the debt with, is it still with the original creditor, or has it been taken over by someone else through them buying it. Also, record the conversations you have, document the phone calls, etc. They will say that they will take you to court but if you do everything you're supposed to and they don't uphold their end of the bargain, then if they do take you to court, you have everything you need.
