Would a court make me make payments I can't afford?

If BOA sues instead of settling and the judgement is against me, willThey garnish my wages to where I don't have enough to pay mortgage and such?


You'll need to take proof of income with you to court and show the judge what you can afford, usually judges are fair, especially if you have a family to support. Another suggestion I have is to take in a budget which will show the judge what you are going to be able to afford, you might also take along receipts proving that the budget is valid.

Welcome to the Community :D The others gave you great advice. Have you answered the suit yet? Or has it already been done?

In our county, you have to put in your answer that you will suffer a hardship, and why if the judgement is large, and then be able to document that.

Shazz is right, the judges will work with you, they won't make it where you cannot eat or anything. It may be tough with the judgement, but they can't take everything.
