Just got letter from Encore (CA)....can I now settle?

Just got a letter from Encore Receivable Mgt Inc saying that my account was referred to them. This is in reference to my BofA credit card. My first missed payment with BofA was on 3/16/09.
Now that I am with a Encore, can I start negociating a settlement?
Or is it too soon?
Do I negociate with Encore or BofA?
If Encore is calling me, does this mean BofA charged off early?
Just not sure what my next step is. I am mailing off my Debt Validation/Cease and Desist to Encore due to their bad rep.

First get the debt validated from Encore and then go for settlem
First get the debt validated from Encore and then go for settlement. If the debt is now with Encore, you need to settle the debt with them. You can pull out your credit report and check whether the debt has already been charged off by BofA or not.
