I am in the state of Alabama
The original company that owned the account "closed" in 2003 and I guess a third party collector purchased the account to collect on, but this account actually was paid out close to the end of 2004.
I need to know can this third party collector "re-age " this account and legally sue me?? The statue of limitations in the state of Alabama is 3 years according to state law, therefore this debt is more than 5 years old if they are trying to say the account went delinquent in 04' or 05'.
The third party (Midland Credit) states they tried to contact me although I do not recall nor would I have even known who they were considering they weren't the creditor I had been paying, long story short can they legally sue me??
I have received a summons and I want to be certain how I should handle this. Any information on this would be greatly appreciated. I need to respond in the next couple of days. Also, If I been served asummons for an old credit card debt can I contact the attorney the creditor is using for questions?? I just want to be sure it will not cause the old debt to become "new" again. This debt is an error and I will go to court if I have to. Also are all credit cards considered "open accounts" or are they contracts. Any feedback on this matted will be greatly appreciated .
