I was served a summons from 2 BOA accounts I have - totaling $15000 - later this month I plan on meeting with a bankruptcy lawyer, but I have a few questions...

1) What do I do to answer the summons? Just visit my local courthouse? When answering it...is it just paperwork or what?

2) If I claim the debt in the summons, how soon would a trial date be set?


well as far as an answer to the summons is concerned, its "anything in writing" that accompanies the filing fee required. the "answer" itself is the easy part. see you in a few weeks when you ask us how to answer the interrogatories! if your state avails legal aide, use it!

the latter question - i imagine is up to how backed up your courthouse is.

i might also add that you need to be prepared for whats involved in answering the SAC. its not a one and done project. be prepared for the discovery period - be prepared to answer questions your not sure you need to answer. its a complicated process, and its complicated for a reason. thats why you should employ legal help if its in any way an option. otherwise you might feel overwhelmed.
