I didn't sue them, but did file complaints with the BBB in their area and with the Florida Attorney General's office. I finally did get my money back, though they sent responses to both the Attorney General and BBB that had numerous untruths and things to try and make me look bad.

I too filed a BBB complaint against Hess Kennedy but only because I thought they were the ones i signed with. It was my credit counselor that lied to me.
I recommend going directly to the company that will handle your debts not the referral agents. The referral agents all lie.
Hess Kennedy settled two accounts for me but I could not wait 3 years to get out of debt so I cancelled.
They did fight me for a complete refund because of the settled accounts. I did get a refund. I think they fired the person that was handling refunds because it caused a lot of complaints.

HK put thru debits to my account on dates other than the agreed draft date, which caused me to be overdrawn, then charged me $30 for the pleasure. They admitted no wrongdoing. Then, when the complaints were filed against them, they responded by saying I bounced checks. Not true! Also, they claim that they don't do debt settlement, the referral credit counselors didn't give correct info. This is also not true, as my contract, which HK sent me states in black and white that I am using them for debt settlement.
