:?I have also gotten a call from a ADR firm for collection. They did not state what the collection was for. Just a short message saying blah blah I have been notified. I am filing bankruptcy and this is first they have notified me. I have told my lawyer and he says they can be fined because I have legally am in filing of bankruptcy.


The court will order an automatic stay on your creditors once you file bankruptcy. Due to this automatic stay, none of your creditors will be able to take any actions against you. If your CA is calling you without knowing this fact, then you can provide him with the contact details of your bankruptcy attorney and inform the CA that you've filed bankruptcy.

If the CA still calls you after informing him about your bankruptcy filing, then you can take legal actions against him.

CA's cannot read crystal balls. As I said above, there is NO violation in calling if you have not filed...many debtors will threaten bankruptcy but until they notified by the courts or you give them the filing number they are free to call. However if you give them your attorneys name and number, they have to call your attorney.
