Using multiple company names

Hi,
I'm wondering if anyone know, is it legal for a pdl or any collection agency to use a company name other that the one you originally contracted with? As I said in another post, I'm dealing with DMS marketing and they are attempting to take money from my account using the names DMS Marketing, Check Recovre and Exprescash/loans. I have attempted to make payment arrangements with these people, and have even agreed to terms suggested by them, but now they refuse to acknowledge this and have tried to debit my account for the full amount of the loan.


I'm assuming it is legal because they can say they are registered by a certain name, but dba something else. This is quite common. I have had debits that show a different name than that of the name the pdl goes by, as I'm sure others have.

If you read through the posts, I'm sure you'll see this advice given quite a few times....close your acct. and open another one somewhere else so that can no longer get access to it. They'll definitely be more willing to work something out with you if they know they can't dip into your acct., and you can have your paycheck back again and avoid NSF charges.

No but they will. The best way to stop them from debiting your account is to close it and open a new one. A lot of people here have had similar experiences. It might be a hassle to close the account but in the long run it will be worth the hassle. If you do this you need to make sure to not give your new account number out to any of the payday loan companies.

Although some of these companies agree to payment arrangements, some of the down and dirty ones will try debiting anyway. They want their money and don't care. Although I wouldn't really refer to any pdls as reputable, a lot of them will abide by a verbal payment agreement. Obviously this one isn't, which is why it would be a good idea to close your acct.

If you don't have their agreement in writing, it's hard to prove anything, and the bank most likely won't be very sympathetic if you go to them with this problem. You can try talking to the bank to see if they'll block the debit, but the pdl is probably using multiple names when debiting so you won't anticipate which one to try blocking and they might be able to hit your acct. when there's some money in there.

Well, I finally called DMS and spoke to Ms Hampton. After she informed me that the called was being recorded, I told her that I was also recording the call for my own protection. I then told her that she needed to read all of my emails, especially the ones stating that I agreed to her original payment plan. First she tried to say she never got that, then she said that she didn't scroll down enough. So, in the end, I got the loan amount knocked down by $100, and she will send me a letter with the arrangment we made over the phone. Hopefully this will work, cause I'd hate to have to sue these people.

The first step will be to explain your bank about this activity. Tell them that you want to file a dispute with the company and demand that they should provide assistance in accordance with Federal Regulations E. when you are disputing with the company over the debit, let them know very nicely that you were advised by your bank to the Banking Commission in your state. Every state has a different name for the agency/controller over banks, get the name of the agency before you call the loan company or get to the bank so you can throw it in their face. The more knowledgeable and stronger you appear, the better you will learn.
