love letter from Ameriloan

I just received a lovely email from ameriloan refusing to mark my account as paid in full. They are willing to settle. Honestly, I can't decide if it is worth it to fight them (they're not licensed in this state, and have charged way too much interest even if they were, and have rolled my loan over six times...) or just to pay them what they think I owe ($80).

At any rate, here's the most interesting part of the email:

We have identified your posts on a debt consolidation website and have turned this matter over to our Fraud Investigation Company. They have told us your letter has been sent to other companies they deal with for accounts that you and your husband Darren Russell hold.


And they enclosed a cute little document for me to sign and return to them. The most interesting part of that document is this:

I agree that all previous payment authorizations are valid and direct my bank to honor them.

I agree to give up any right I may have to make any complaint to any court or government agency regarding my account with AMERILOAN.


Um, hello? I might consider settling but I won't let them have access to my account. And I certainly won't give up my right to complain about them to my state's attorney general!

Anyway. Interesting scare tactics. And hey Ameriloan, thanks for providing me with about 10 minutes of free entertainment this afternoon!


Ever notice that frequently when you get an email from a payday loan place there are a ton of misspellings and terrible grammar? I used to want to print the email out, correct it with red sharpie, and send it back. I had one company who couldn't even spell their own name right.
It always makes me smile to think that the people there are uneducated and unpolished.

Then we they send you one of their stupid "letters" they want you to take it serously! I have a "thing" about correct spelling and language usage (the teacher coming out in me). I am not talking about something like a message board or a casual email cause everybody makes typos---but if you want to be taken seriously correct spelling is a MUST.

OOOH, I have a major problem with apostrophes in the wrong place..I have been known to fix menu boards in restaurants..I am also **** about semicolons, but I understand a lot of people don't understand the rule..It just seems that a business would have any literature proofed.

A friend of mine took this at a park in Columbus where he was playing with his kids..

I told him to go over there and correct it..Or be really funny and write a note back and say "Yeah this is MY park, not YOU'RE park. So my dog can go wear it want's two" He said he probably will.

I kid you not.....3 weeks ago, the assistant at the Advance America on my delivery route was going door to door across the street at an apartment complex putting flyers on everyones door about them being open for business and how they could help out in the event of cash emergencies, such as medical expenses, car repairs, assisting with due rent to avoid late rental charges....ha....the rental offices late fees are far less than the fees charged by the store front pdl lol....I wanted to put a note on every door saying....."don't do it....I did and it has ruied my life"

This is good information to use when I have to start the collection process with ameriloan. Im in PA so can someone tell me the max interest I can be charged and to make sure Ameriloan wont try no BS when I have to deal with them. I will be posting this same post as there are 9 others I owe as well, including Geneva Roth, which I got a loan from them and never made a payment on because I close out my account. LMK.

So last week I sent four companies--Ameriloan, United Cash Loans, OneClickCash, and Bahamas Marketing Group--the exact amounts they had withdrawn from our bank account since last August or so. I asked for refunds from all four, which was something I didn't do with my first letters.

I finally heard from United Cash Loans and OneClickCash this morning. Our accounts with them have been marked paid in full and closed, which is a major improvement over last week's responses from them. Sadly, they are refusing to issue refunds. Oh well. Bye bye $1500. Honestly, I'm just happy to have them out of our lives!

The last I heard from ameriloan, I was still committing fraud by posting here. Whoops! And I haven't heard one iota from BMG, but at least I finally found an email address that didn't bounce back.

Anyway. Thank you to everyone for all your help. I'm feeling very encouraged, and I couldn't have settled this mess without all of you! I enjoy this board so much--I think I'll stick around and try to help other folks out with "committing fraud".

Sue, I really think it's interesting that ameriloan (hi there, Ameriloan! XOXO!) didn't email me this morning. I got the emails from OneClickCash and United Cash Loans within about 5 minutes of one another, and thought for sure I'd hear from Ameriloan too.

Tammy, Ameriloan has a very interesting definition of fraud! I wonder if I'm committing fraud when I'm driving to work or brushing my teeth... :)

Fraud my foot lol....they are breaking laws of several states. It is their responsibility to read the laws of states in which they conduct business in....as Virginia says.....

When dealing with payday loans, I was definitely scared. I was scared that I wouldn't be able to feed my kids because of all the debits to our checking account! I agree Sue, I felt so relieved once I found this site and learned about my state's laws. I was a bit nervous when I sent those letters, but I've never been scared because I know I'm in the right and these b*st*rd companies are in the wrong!

I was given a "contract" to sign by a payday company that basically told me they would settle and I needed to pay them a sum of money, which I don't get, BUT I had to keep my mouth shut basically. The same thing that krussell got. I don't understand why I need to sign it if they are obeying the laws of my state. They feel they are abiding by all laws, but want me to sign that paper saying I will not discuss the contract or anything on it. What's up with that? I'm not a moron here. I'm going to use it as toilet paper I think.

I have that I owe them less than what they are asking for. I didn't send the letter that is on the site here, but I did state the facts and laws of my state and they didn't like it and wanted to settle right away. Would not even answer me if they had a license in my state. Irritates me and then they sent me this contract to sign. I don't like it and do not agree with it. I'm not signing it. That takes my rights away. I have every intention to finish paying off what I owe, which is a small amount, but I am not going to be played with like that. They charged too much for the payments by my state laws and also are not licensed in my state. I quoted my state's laws to them and that is what I got back. Basically, shut up and let's make a deal. Not gonna happen so easy. I'm just sending them the payment and not signing any forms.

Well, we finally heard back from ameriloan this morning. They're refusing to write the loan off and are sending the total amount due to collections. Funny thing is, according to our former bank and the laws of our state, they actually owe us $60. Too bad they don't see it that way.

So I'm girding my loins, getting ready for phone calls from collectors. I'll definitely ask for a debt validation letter...any other suggestions?

I contacted our state's attorney general's office about Ameriloan on Tuesday morning--sent them all our documentation Tuesday afternoon. Hopefully they'll get back to us early next week...

Still, ugh. I halfway feel like Ameriloan is refusing to settle when the other payday lenders did because of this thread...I don't regret posting here, but I'm very very grumpy with them for making us take these extra steps. I'd even use bad words, but then the spam filter won't let me post. Believe me, I've tried... :)

They probably are refusing to settle because of this site. Please let us know what your Attorney General says. I would suggest getting a Lawyer and sicking them on Ameriloan. You might be able to find a low cost attorney through Legal Aid. Otherwise I wold be tempted to let this go to court (assuming they are stupid enough to let it go that far), and see look on their faces when you present your case to the judge outlining their violation of State laws. I suspect they will not take this to court and try only to harass you, in which case I would obtain a legal order barring them (their agents and assigns) from contacting you, or your could take THEM to court and sue them asking to have the account declared paid by the court..

You say they are not licenced in any state? I live in Arizona and have a loan with them - I think oneclickcash is also ameriloan which is rio resources is it not?
