Bank levy on joint account.. Not married

Me and my girlfriend have a joint bank account with Bank of America that had a bank account garnishment put on it 2/18. My pay check from work went in 2/20. Found out that Capitol One had obtained the levy in Henrico County, VA. We lived in Virginia Beach for about six months then moved to MA in 11/2007. She has recieved numerous calls and notices in the mail from Capitol One and even made a settlement on a different account with them from our current address in MA written all over it. Long story short she was never summonsed to go to the court. Can they sue her in VA and not summons her at her last known address in MA? Does this qualify as improper service? Improper venue? And the garnishment on the account is done be her social can they take my paycheck even though we are not married?

Keep in mind if they do get a proper judgement, they can seize any money including yours that is in any bank account her social security number is attached to. Get your own account.
