Barclays trying to scam me on settlement
Date: Sat, 07/02/2011 - 17:09
Today I called them asking about my settlement and they say I've defaulted?!!?! because the last payment didn't clear until the next day - the 29th fell on a sunday. All my previous payments all cleared from my account 1 to 2 days later than the date. The money has always been in my account but they're trying to say the last payment didn't clear on the 29th?!?! Never mentioned the other payments taking a day or 2 to clear?
Man, I'm royally PO'ed.
Also the 30th of May was memorial day but if I write a check or
Also the 30th of May was memorial day but if I write a check or as in this situation set up an automatic payment it should be withdrawn or verified on that day.

Clearing your account is a moot point....it is the date that is deposited that is what the settlement is based on. They may have gotten you on a technicality.....your payment should have been dated for Friday the 26th. However it they set the payment date on the 29th and you have it in writing, you should be able to fight it
The agreemnt states: "Pay the remainder of the settlement total
The agreemnt states: "Pay the remainder of the settlement total by 05/29/2011."
What can I do to fight this?
That's probably why they were so snide when I spoke to them.
It says payable "by"....which means the payment has to be posted
It says payable "by"....which means the payment has to be posted on or before the 29th. They may have gotten you on this one.
I bet you they said if not paid
I bet you that your settlement said if not paid as agreed on those dates it would revert back to the original amount owed. Been there done that with a different company. They will get you anyway they can.

So do I have to go through the whole process AGAIN - wait them out for 6 months and settle again?
Wait them out
I would wait them out. Is this company even legal to be collecting from you? I hope you have all necessary documents that prove what you have paid. If they received the last payment even though a day late, I think you should be good because you fulfilled the agreement, and if you decide to pursue this further, You have the documentation to prove that the other payments were late also and they accepted them

The poster has not made it clear who is collecting....Barclays Bank internal or outside collection agency.
fyi...Barclays is hardly a scam. Barclays Bank is over 300 years old (yes three hundred) and is based in the UK. They have several US based credit card products.
Did not make it clear
Yes, I was not sure who Barclays is or on what they are collecting on. It seems awfully funny that they accepted late payments in the past and now on the last payment he has defaulted? Sounded pretty crooked to me.
The card is from Juniper/apple credit a division of Barclays ban
The card is from Juniper/apple credit a division of Barclays bank. Juniper is who I made the settlement with. Whatever your thoughts they are using misleading and fraudulent tactics. I have all the bank statements and the agreement.
Sounds like your settlement was in house, not in collections. Y
Sounds like your settlement was in house, not in collections. You had a written agreement...you can try appealing to someone higher up but due to that word "by", your payment had to posted by the 29th.
They may not let you settle further.
Thanks for all your positive thoughts Soaplady:rolleyes:

Actually, it doesn't state that in the settlement agreement. Only mentions IRS payments

YESSSSS!!!!! Lesson learned: Don't deal with the Mumbai represenatives. Go directly to the source.
I pray this is the last I have to deal with them.
