You have mentioned that you did not receive any papers earlier and the judge hasn't signed the papers that you've received now. The whole thing seems shady to me. I hope you've a lawyer. You should contact your lawyer and show him the papers that you've received. He will guide you as to what you should do in this regard.

First thing you should do is contact the court clerk's office where this is supposedly in progress. Ask them to verify whether or not any lawsuits are against you. You need to know what youre up against before you can respond. If you find that no lawsuit has been filed against you in that county, then you need to look for a consumer attorney on www.naca.net and file a lawsuit of your own against the debt collector named on this paperwork for their FDCPA violations. If you do find a lawsuit has been filed against you, you need to review the docket to see exactly what has taken place. Be sure to check the specifics on the information about the service of summons--if they never served you then you can file to have the whole mess stopped in its tracks. Check this out and get back to us with what you find--if there was already a judgment ordered against you, you can file a motion to vacate judgment due to improper service. If there has not yet been a judgment ordered in the case, you can file an order to show cause/motion to dismiss due to improper service. Let us know what you find and we will go from there.
