Being Sued by credit card company

Hi everyone! This I'm have question for my parents. Back in the fall they turned all there Credit cards over to a debt consolidation company to help them pay there billings and get out from under them. Everything seemed to be going well until yesterday they were got a summins to appear in court because there Sears card was taking them to court for not paying the bill. When they contacted the Debt consoildation company they turned them over to there lawyer which is to send them info and what to say at the hearing but he did tell them on the phone that they sent a latter to sears with a offer but they never responded. Also that Bank of america never did respond either and they now have contacted them about paying but all there other credit card companys have taken the settlement offers. Can Bank of America and Sears legally take them to court even if they have been contacted by a consoildation company but never responded to there requested? Any help?
