This company contacted my mother in law regarding a DB account that my husband had. They told her how much the original debt was (which was not correct), they automatically agreed to settle for half of wha they said the original debt was, and they charged her CC for more than they agreed to settle for. They had absolutely no permission to speak with her regarding this account. We didnt even know who they were or that they were calling her until after the fact. What can we do about them violating my husbands privacy and getting her money back?


Brachfeld Law Group is a collection law firm. I guess your husband's original creditor has sold off his account to this law firm. It is against the FDCPA rules to contact friends or relatives of the borrower and inform them about the person's financial situation. You and your husband can take legal actions against them. Moreover, it is quite surprising that they debited money from your mother-in-law's account regarding your husband's debts. I will suggest you and your husband to contact an attorney and he or she will advice you as to what actions you should take against Brachfeld Law Group so that your mother-in-law gets back her money.

Anna....please do not guess. Collection law firms are routinely hired by the original creditors ...whether or not the account was sold is irrelevant and not even an issue here.

Original poster....your in laws need to contact their credit card company and dispute the law firms charge as fraudulent Have your in laws write down all the events of the phone call and go have it notorized...their bank will do it for free. You need to hire an NACA attorney....you have a great case which I am sure any consumer attorney would be happy to take on. There are so many violations plus you also have pain and suffering (punative damages) plus the embarrassment of disclosure of this debt to a third party. My guess is you will make at least $5k after the attorney takes his cut.

Thanks for your suggestions, Soaplady.... I know that collection law firms are routinely hired by the original creditors... I guessed because it is the OP who was not sure about who was calling them and whether or not the company had the rights to call her mother in law regarding a DB account that her husband had.
