I just called and they told me the company has to be in receivership.. can you let me know what you find out i am in So Cal they directed me to the FTC web site..
i will call the police if that will work
I know mine is working outside the law 6 payday loans at 1 place and wont give back paid checks until ALL are paid...

I asked where i can get help with the PDL that i am in touble with.. she was nice and looked but said they did not have any complaints yet so i had to start from the form and so forth.. I am still going there Satuday with ca law in hand to see what i can do..

where are you going? They did not have complaints for the company you were asking about... Is that what you are saying?

They have 0 complaints about the company i am dealing with, my payment is due saturday.. no money to pay. i called my bank and put stop payments on all the checks and when i go to the PDL storefront i am taking a copy of the law if i dont get all my checks back i will file a complaint with the state of ca..

You have to be really carefull telling someone that something is illegal, if you don't know all the details. Store front lenders can, and oftet do take things to the level of judgements, because they are local. So if you are dealing with a store front, try to see what can be worked out with them. Also if they are doing something that is illegal, you must have laws and documentation that backs you up...Karen

I do have the law on my side.. ca law is that a PDL can only issue 1 no rollovers and must post fees and have a signiture..
she has 6 of mind i have been paying a year and nothing is posted and i have NEVER sighed a contract i cant even get an accounting. Until i found this site i thought i would get arrested for speaking up now i know that is not true and i am not afraid anymore stressed but not afraid

You're right JN. I know that every storefront loan I ever got in CA, I had to sign a contract (in some cases, it was pages) and every place always had their fees posted. In some ways, she's screwed, because if there's nothing in writing, how can she prove she loaned you the cash, right? Just a thought...

Bossy is right about storefronts, you will find they are licensed and operating legally. The press release they issued on Sept. 8 was about internet pdls operating illegally without a license to consumers in their state. It didn't prohibit storefronts.

well i went and told them that i would be in default and handed her the copy of the law.. i was shaking really bad.. she started to say i would go to jail and i told her to stop and read the law.. i even took pictures of the wall that shows nothing posted.. except i was shaking so bad i am not sure if i got what i needed.. of course the manager was not there like she told me she would be.. I guess i will see.. if they take me to court i can show then that they have the 6 checks again aginst the ca PDL law...

Good for you! :D I don't know if I would have the courage to do that! And if I'm correct, you are in CA, and they don't allow for criminal prosecution on defaulted pdls. You got some courage! :D

Please i was so scared.. then the manager called me when i got home and told me she was my friend and she could loan me more if i needed it.. I said that was the trouble... she kept loaning me more... i told her no i had to take care of me.. and with all i have paid i couldnt pay anymore. and she could take me to court and i will file with the dept of corp and the ag and lets the chips fall where they will.. she told me she wouldnt waste her money fighting me in court.. it is a longer story but bottom line i stuck to the law that this site help me find and I will file if i dont get my checks back... She knows that she is breaking the CA law.. as a matter of fact she said she is not a PDL.. so she is loaning without a licence...
anyway thanks for the help... 1 more to go and they are legal and i will pay them off..

I agree with Steelers, that is awesome! But wait a cotton pickin' minute here: You write this "friend" a check, she holds it to your payday and you renew by paying it off along with a fee? If this isn't the dictionary definition of a PDL, then I don't know what is!

yes you are correct this is a PDL.. and if she doesnt due what she is suppose to do.. i will file.. and then she will be in trouble and i think she knows that.. i have my fingers crossed until the mail comes and then if nothing i will mail my complaints thursday.. we ask for tine from the PDL i felt i had to give her the time to mail me the checks...
I just am so thankful i found this site it gave me the courage to stand up for myself..

jn, Hope all works out well with you. I would make sure I got some good counseling. I would call the Attorney Generals office and ask for some advice. They are the law in your state and can give you advice. Best Wishes KYSIDE38

When I called the AG office they told me to call the dept of Corp.. and wont talk to me until i have a complaint number.. I did also on Monday send a certified letter the PDL and i said if i did not receive ALL checks by Wed. i would file the complaint on Thursday.. so far nothing i will check the mail when i get home and i dont work on Friday's so i will get all the papers filed then if i have too... I know i am in the right she is not licenced in the state of CA for PDL on real estate..

well i knew it was to good to be true.. nothing ever came in the mail.. But also no phone calls.. I sent a Cert Letter RRR and got that done filed on line complaint with AG and now i am send the complaint to the Dept of Corp state of CA.. and see what happens. I am hopeful that my complaint will help all the others that she is taking advantage of. I am so surprised because even on the Phone last week she admitted she was working "OUTSIDE THE LAW". You would think she would not want me to file.. I kinda of hope she is filing court papers. then i can fight this in court. I guess I just sit and wait.. and the stress it more then i can take..
My fear has returned fear that they will show up or start the calling..

I think maybe she believes you are just blowing hot air and not filing your complaints. I think you are doing the right thing, I know the sitting and waiting is stressful. Good Luck. I think you will prevail. :D
