How do we go about this?

My husband had a car repo in 2002-03, maybe. The debt dropped off his credit report over a year ago, so we don't know the exact date of last reporting by the creditor. A Collection agency is now calling trying to get him to pay. Do I need to first ask for a debt validation letter then send a SOL letter to these people, or can I just send a SOL letter? We are in California, the origninal loan was in California. 4 years is the SOL.

why?it is not on your CR and you have even a smidge of proof that it's time barred.unless you want to pay it,i wouldn't even bother.i will ask one question.

The original was Long Beach Acceptance Corp., then the repo fell to Ameritrade I guess. I never really paid attention to it, as it was my husband's issue before I ever met him, and it fell off his credit report in time for us to get a mortgage so what did I care? Anyhow, this company has been calling (cell phones with a robo-dialer BTW) and they sent a letter stating if he didn't ask for debt validation within 30 days they will "assume this debt is valid"

yes it is beyind SOL,and MRS knows it as well.do as SOAPLADY advised.get an FOAD letter out asap.if you are still uncertain do a search for MRS in the bar top right.this is a JDB that tries to get money out of debts that are past SOL.that is what they do.this is not a legit collector at all.get the letter out certified mail return receipt.
