I received a letter from a law firm in Millbrae (CA). The law firm informed me that I have been sued by a collection agency. I have not owned a card in the past 5 years. Moreover, I have not received any papers also. I did check the court website. I found that a case has really been filed against me. Is there any way to dismiss the case before the court hearing date? What about the SOL period? It should have expired by now. Right? I can’t afford to pay the fee charged by the law firm. I’m living on unemployment checks for the last 4 months.

When was the date of your first deliquency for this card?? If it has been more than 4 years (check your credit report) use that as the response to your summons, telling them the SOL has passed, the debt is time barred and to respectfully dismiss the case. Send a copy to the courts and the law firm.
