can target visa do this to me?

I live in Minnesota. My bank account was recently garnished from a Target Visa that was from over 4 years ago and is a judgment on my credit. The only thing I got from them was paper to fill out and talked about them garnishing wages. I was never summoned to court. Just got the paper about a week ago. I don't have a job. What do I do or what can I do? They took my child support money and left me with nothing in my account.


1. File with the court a motion to vacate the default judgment and the writ of execution for lack of service. Get the entire court file copied from the court so you can see what happened.
2. Contact their attorney, tell them you were never served, that you suspect they were responsible for sewer service, and for taking your child support payment. Tell them if this isn't resolved promptly, you would have to take the issue with the state bar.

Child support is exempt from garnishment.

Did you know you had been previously sued?

Garnishment paperwork does NOT require a court hearing. However it they seized your bank account knowing that the funds were exempt, there may be legal implications.

You will need to talk to the court and the banks legal department on Monday to let them know that the funds seized were exempt. If you need a Minnesota attorney, Pete Barry 612-379-8800 is a well know consumer attorney. I am originally from the Twin Cities and have used him.
